TO BIAS NOW! • The 15th Amendment (1870) guaranteed Black Americans the right to vote, but Southern states immediately worked to undo it. • Jim Crow tactics included: literacy tests, poll taxes, grandfather clauses, whites-only primaries, property requirements, and "moral character" tests, all designed to block Black voters from voting. • Black voters faced not just legal barriers, but also harassment, economic retaliation, and physical violence when they tried to register. • In Selma, Alabama, a city with 15,000 Black citizens of voting age, only 335 were registered to vote before the VRA. DEFIANCE DISPATCH WHAT THE VOTING RIGHTS ACT ACTUALLY DID • Banned literacy tests and poll taxes: the primary tools used to block Black voters from registering: • States and counties with a history of discrimination had to get federal approval BEFORE changing any voting law or procedure (Section 5). • Banned any voting practice nationwide that resulted in racial discrimination (Section 2). • Gave the government power to send examiners into discriminatory districts to register voters. • Because of it, 250,000 new voters registered by end of 1965; the racial voter registration gap dropped from nearly 30 points to just 8 points by the 1970s. • The VRA was reauthorized & strengthened in 1970, 1975, 1982, and 2006, with bipartisan support. SCOTUS STRIKE 1 IN 2013 5-4 A central portion of the Voting Rights Act is unconstitutional Kennedy Roberts Alito Scalia Thomas Kagan Sotomayor Breyer Ginsburg • In a 5-4 decision, the Court struck down the formula that determined which states had to get federal preclearance before changing voting laws. • Without the formula, states with the worst histories of racial discrimination were free to change voting rules without any federal check. • Texas announced it would immediately enforce the nation's most restrictive voter ID law, one that had been blocked under preclearance. • Alabama & Mississippi moved to enforce new voter photo ID laws that were awaiting federal approval. • In the decade after Shelby, 19+ states enacted new voter ID laws, closed polling places, and cut early voting.
