On Birthright Citizenship:

“The Reconstruction Amendments were an anticaste, antisubordination reset for the Nation, not a mere spot treatment for the dark stain of slavery.”

Justice Jackson:

Also, Harlan's color-blind line is an anticaste principle, but that ship has obviously sailed past this Court

Freed Blacks did not advocate for a unique set of rules that catered only to their situation. Nor did they seek to advance their own position relative to, or at expense & exclusion of, other marginalized groups…The firmest foundation for freedom require[d] an anticaste reset…& would benefit all. Justice Jackson's dissent was on point - "But that narrow vision of the 14th Amendment bears little relationship to the history of its ratification...The Reconstruction Amendments were an anticaste, antisubordination reset for the Nation, not a mere spot treatment for the dark stain of slavery."

The first paragraph of Justice Ketanji Brown Jackson’s concurrence is a devastating takedown of Justice Thomas’s heinous opinion:

“The Reconstruction Amendments were an anticaste, antisubordination reset for the Nation, not a mere spot treatment for the dark stain of slavery.”

Powerful to read KBJ’s reply to Thomas’s dissent in birthright case that tries to particularize birthright citizenship to newly emancipated Black people. Jackson’s reply is a moving defense of an anticaste system & rejection of narrow conception of Black Americans’ longstanding democratic advocacy.

In its latest ruling gutting the Voting Rights Act, the Roberts Court has inverted the Reconstruction Amendments to justify the same racist devices and practices they were adopted to dismantle (🎁) www.theatlantic.com/ideas/2026/0...

Love the nuance, Justice Brown. Anticaste & antisubordination - a powerful reset for our nation's foundation.

Justice Brown Jackson's argument for birthright citizenship is very moving. I recommend reading it in full. An excerpt with alt-text below.

But that narrow vision of the Fourteenth Amendment bears little relationship to the history of its ratification. Even worse, Justice Thomas’ telling elides the entire point of the Second Founding: The Reconstruction Amendments were an anticaste, antisubordination reset for the Nation, (cont.)

“The Reconstruction Amendments were an anticaste, antisubordination reset for the Nation, not a mere spot treatment for the dark stain of slavery.”

— Justice Ketanji Brown Jackson’s concurring opinion for ‘Trump v. Barbara,’ (2026) upholding birthright citizenship in U.S.

In the 20-page concurring opinion, Jackson drew not only from constitutional knowledge but also from scholars including Frederick Douglass and Isabel Wilkerson, who is the author of Caste: The Origins of Our Discontents – describing the amendment as giving the Constitution an "anticaste engine".

You know I post about genocide in Gaza, about the erasure of Muslims from India, and when there is something to share - bluesky is still not very plugged in to these struggles - anticaste and feminist struggles in India.

Jackson's on point as always: "Even worse, JUSTICE THOMAS’s telling elides the entire point of the Second Founding: The Reconstruction Amendments were an anticaste, antisubordination reset for the Nation, not a mere spot treatment for the dark stain of slavery."

Appointing Ketanji Brown Jackson to the Supreme Court may be the best thing Biden did in his entire term.

"The Reconstruction Amendments were an anticaste, antisubordination reset for the Nation, not a mere spot treatment for the dark stain of slavery."

She is the GOAT.
