When did you contact the Department of Communities?” To which [redacted] replied as follows: “Thanks for your email, we will provide you further updates once we will receive them from the contractors and the Department.” Considering the content in [redacted]’s emails from May 6th does not, in fact, match the information provided in the below email dated 19th June 2025 I’ll thank you all for refraining from using the “per previous email” turn of phrase in correspondence with me moving forward. An email from me to my housing provider that reads: "Good Afternoon I just wrapped up a visit from [head contractor]’s asbestos contractor. He confirmed he has a Class B removal license and an assessor license. He advised me that he had been instructed to visually inspect the premises with a view to create an asbestos register document and report works required. I provided him with printed copies of the existing asbestos register, the ABBC building inspection report from 2022, and the lab analysis results from the 2019 asbestos samples. He also advised me that he was not instructed to dispose of, sample, or encapsulate any asbestos today. Following visual inspection of the property, including the piece of fibre cement that fell off the eaves, he confirmed it is highly probable to be asbestos and took samples of the eaves, kitchen wall, insulation under the kitchen sink, under the vinyl tiles in the kitchen, pieces from the smashed bathroom wall, and a fragment from the dirt in the rear yard he suspected to be asbestos. He said he would report the need for air monitoring inside and outside the property with particular concern for the smashed bathroom wall, as well as a full sampling process of the dirt in the yards deposited by a previous asbestos remediation contractor subject to my ongoing complaint about the unsatisfactory results of those works. [alt text continued next image] He also verbally confirmed that this was his first attendance at this property, as he had been organised to meet [head contractor] here previously but [head contractor] cancelled on him. Due to [head contractor]’s ongoing propensity for outright lying to protect himself I will not be dealing with him or his company until I have video surveillance operational at the premises in order to have objective record of what occurs here. As it stands, [head contractor]’s and CHL’s failure to provide the asbestos register to every single contractor who has attended this property is a reportable offence due to the imminently-to-be-confirmed presence of asbestos. I will be notifying WorkSafe of this myself and naming CHL’s asset managers, past and present, as the person/s with control of the workplace. Further, the Department of Communities has accepted unchallenged CHL’s false representations as to my refusal to permit the premises be inspected and refusal to be reaccommodated for major works, so I will be forwarding this to the WA Ombudsman as part of my complaint escalation. I expect to be notified of and provided with a copy of the asbestos sample analysis results and report as soon as it is provided to CHL without having to resort to extreme measures I have used in the past, such as reaching out to the WA Greens to advocate to the Minister for Housing on my behalf. Having now seen my assertions that CHL’s current asset manager is indeed demonstrably incompetent in asbestos management protocol I will not be unblocking [asset manager]’s or [housing services manager]’s email addresses. I am prepared to work with an appropriately trained and qualified officer in their stead. I am happy for this contractor to reattend in the near future to carry out air monitoring and soil sampling with work orders issued directly to him by CHL in consideration of [head contractor]’s failure to provide him with the information he requires. Due to this transition, the Complaints Management Unit (CMU) will no longer have authority to investigate Tier Two Housing complaints and are no longer accepting requests for Tier Two investigations. The Department of Communities has raised your complaints with Community Housing Limited, and they advise that you have denied access to the property. Community Housing Limited wants to inspect the property before arranging for suitability qualified people to inspect and assist with appropriate repairs, but you refuse access. Community Housing Limited also advise they attempted to arrange for alternative accommodation to assist you and your family to temporarily reside elsewhere while any repairs are completed, but this was not successful. I must remind you that the Residential Tenancies Act 1987 (the Act) outlines that access must be permitted to allow a property manager to inspect a property and arrange necessary repairs. Failure to comply is a breach of the Act. The Community Housing Registration Office have noted the issues raised and information provided with regard Community Housing Limited, and this will be raised at the next annual compliance assessment. We encourage you to work with Community Housing Limited to assist them to inspect your home regularly to ensure it is well maintained for your comfort and the comfort of your family. Yours sincerely Commissioning and Contracting Division 14 April 2025 An email from me to my housing officer at CHL on 14th November 2024 that reads: Hi [redacted] Even if we could afford the discounted fee, which we can't, it takes several weeks to complete a full vaccination course. Additionally, the wait time for appointments is typically weeks and there are often vaccine supply shortages. Cat Haven's website estimates a 5-week process, not including appointment wait times or supply issues. At this late stage it doesn't look like Fred will be vaccinated in time to be accommodated anywhere by Christmas even if we were to receive an unexpected windfall. I am urgently trying to go into debt to replace our portable air conditioner so I can avoid literal heat stroke inside my house. CHL won't even commit to improving the energy efficiency of the property by replacing the insulation that was removed from the caving in ceiling once that ceiling is replaced, let alone paying for energy efficient split systems to reduce how much it costs us to make this place livable. Vaccinating my cat according to CHL's schedule following the abrupt decision to finally relocate us and undertake major works at the property more than 2 years after the building inspection does not rate at all in my list of urgent financial priorities. Accommodation should have been the first thing arranged, not the last. Nobody has confirmed that the insulation in the kitchen will be replaced at any stage. It has been missing for 5 years, and every summer I get heat exhaustion because the indoor temperature at this house reaches and exceeds 40 degrees Celsius. I have tracking data to prove it, which I have provided to the media in the past. I have never paid to live in house with such poor temperature control. I'm not postponing replacing the portable air conditioner for this when it's a health issue for me. I again ask that you work with me rather than against me in dealing with this because my mental health is still dicey and I have gone to every effort to work with you at great cost to myself. Had I not been aware of asbestos management policy myself and had I done as instructed, I would have committed an offence under the Health (Asbestos) Regulations 1992 (WA). Has [redacted], as the CHL officer with a duty to exercise due diligence in ensuring undertakings comply with Work Health and Safety law, since received training in asbestos management policy? I would recommend [redacted] not attend the premises without receiving that training because his misconduct has demonstrated that he is unable to meet that duty. CHL does not seem to be taking this matter as seriously as it should be under CHL's Risk Management procedure and Duty of Care policy. Regardless of whether [redacted] attends or has received training, I will at the very least have the name of the individual asbestos removalist attending the premises so I may verify their licensing on the DMIRS website myself in lieu of CHL's due diligence. Therefore, you were not entitled to refuse access on the basis that you are not qualified to assess the credentials of contractors appointed by CHL. [redacted] has previously confirmed to me in a phone call that he does not hold an asbestos removal or assessor license. After 6 years of the latter, I now insist on the former. This would not be the first time [redacted] or someone else at [redacted] Pty Ltd has lied to cover themselves in any dispute or a dispute specifically related to asbestos management at this property; I have made multiple formal complaints to CHL about this behaviour and CHL chooses to continue giving them jobs and money. This is ridiculous in a technological age when many people, even poor people, have doorbell cameras or other video surveillance at their homes. Moving forward, if you want me to deal with [redacted] at all considering their ongoing misconduct you will procure a licensed asbestos removalist and assessor who will have their qualifications and work orders checked at the door. Otherwise, you will procure contractors from outside [redacted] because they will have no reason to lie, and I can trust that they are not making false representations to protect their own interests. I am drafting an application for court orders to get this matter dealt with appropriately. If CHL manages to succeed in sending the appropriate contractor for the appropriate work I will gladly grant them access to the premises and cease this action. Anything to the contrary will result in me issuing a breach notice to CHL for interfering with my quiet enjoyment (being the reasonable peace, comfort, and privacy) of the property and I will add a request for compensation to my court application. I have been regularly updating the Department myself on CHL's ongoing failure to ensure urgent repairs are carried out by a suitably qualified repairer, and I will continue to do so. It is CHL incurring liability here in addition to the continuing liability from inadequately managed asbestos in 2019, not me. Just send a licensed asbestos removalist to remove the piece that fell off, encapsulate the remaining eaves, and a licensed asbestos assessor to inspect the premises including taking samples. The incident occurred on 13th Jan, I notified of the need for urgent repairs the same day. I breached CHL on 16th Jan for failing to carry out urgent repairs. I lodged this complaint with the Department on 18th Jan. It's now 26th Feb. Literally zero fucking progress has been made. #AusHousing
My email to the Department of Communities Customer Feedback that says: "Hello It has been 20 working weekdays since I lodged my complaint with the Department. The original receipt email below says to contact this email address if I have requested a response to my complaint but do not receive one within 10 working weekdays. Can I expect to receive a response from the Department and, if so, when? I have had to block another CHL staff member's email address and will have to block CHL's domain entirely if they continue sending similar emails from other addresses that fail to adequately deal with the situation. I am concurrently trying to manage several ongoing health problems exacerbated by the effect of stress on my immune and inflammatory systems, including a chronic skin disease flare-up that may require treatment in hospital if the severity of the infection worsens. My email to the Environmental Health Officer at my local council trying to convince them to do something about the asbestos my housing provider is still not cleaning up that reads: Hi Martha After doing some legal research I have found case law setting the precedent that the law and courts treat Community Housing Ltd as the owner of managed premises such as mine: "The respondent is treated as the owner of the property for practical purposes, pursuant to a residential management agreement under s 16A of the Act with Homes Tasmania." – paragraph 4 of the reasons for judgment in Jordan v Community Housing Limited [2024] TASSC 63. I've attached a copy of my lease agreement nominating Community Housing Ltd as the lessor, with no mention of the WA government as party to the agreement. I've also attached the Department of Communities' Maintaining Community Housing Assets Guidelines document outlining that Community Housing Ltd are responsible for managing asbestos at the property (Appendix 1 Guideline 3). Community Housing Ltd has legal responsibility for the management of the asbestos at the property and the City of Stirling has jurisdictional authority to issue infringement notices to Community Housing Ltd. To reiterate my original service request, I am only asking for the City to take samples for testing and provide me with a copy of the results. If you could run this past your legal services to verify that the City has authority to act, I would really appreciate it.
