Wait the third element is required for a Caremark/Massey claim? That's new.

Caremark?

Now that's a name I've not heard in a long time. A long, long time.

Fuck you CVS/ Caremark
Stop making it harder for people to obtain their supplies.
October 31, 2026 at 1:51 PM
Caremark continues to be the fucking WORST. Even paying them for shit is hard.
October 31, 2026 at 10:25 PM
like, if they purposely broke the law for some other reason, would that not give rise to a Caremark/Massey claim?

I do look forward to a corporation, say, openly defying a Trump Admin subpoena out of some kind of moral objection or something, and arguing that it wasn't for profits

Fuck CVS Caremark. So you're denying me coverage for one of the medications I literally need to breathe but you "understand it's not the decision I was hoping for"??? Fuck right off, you condescending bastards.

A real possibility, especially if she's anti-vax or has CVS/Caremark as her prescription provider. #HATM

PBMs negotiate with drug manufacturers and help employers manage pharmacy benefits. The goal should be to make costs clearer and help patients get their medications at an affordable price while preserving the value of those negotiations.

What’s wrongheaded about this is the effort to divest their pharmacies. Their real monopoly power comes from owning the PBM. Make them divest Caremark!!! #PBMreform @mattstoller.bsky.social

1/ CVS Health is the 10th largest corporation IN THE WORLD w/ $400bn annual revenues (Exxon is 13th at $350bn). It owns Aetna Insurance, CVS pharmacies (+ 2 other chains), & CAREMARK (the LARGEST "MIDDLEMAN"). It also owns Omnicare (200 nursing homes) & MinuteClinic (800 urgent care facilities).

Without that caveat, "Delaware does not sanction lawbreakers," and you'd see potential Caremark liability. As expressed above, the case is much harder. Given the pretty obvious turn in the Trump EEOC, preparing a bulwark against that case is predictable. (Although I can't think who would bring it.)

There is no nastier monopoly than CVS Caremark
October 23, 2026 at 5:11 PM
It would make me very happy if a great hand just reached down and scooped up the entire CVS/Caremark corporation and removed it utterly form the face of the earth.

This should be interesting! We encourage the Committee to press these PBMs on their #340B practices...

CVS has been enshittifying for quite some time. They also use their Caremark branch to fuck local pharmacies and steer more money to their parent company. And of course, they understaff their own pharmacies. I feel so bad for those pharmacists when every impatient customer yells at them.
October 23, 2026 at 5:14 PM
PSA for anyone else struggling with the stimulant med shortage: apparently CVS/Caremark Mail Order pharmacy can get stuff (while zero individual local pharmacies can, including CVS, at least near me…)

So if you’re almost out of exec function… try them?

(Do I fear this is the start of a monopolist
