👏🏼 #SCOTUS "has long held that 'a pardon cannot stop' courts from punishing cases of #civilcontempt. And while the marshals have traditionally enforced civil contempt orders, the courts have the power to deputize others to step in if they refuse to do so." 👍🏼 #RuleOfLaw ⚖️

Judge finds Giuliani in civil contempt over 2020 election case
A judge on Monday found Rudy Giuliani to be in civil contempt of court in a $148 million defamation case brought by two Georgia election workers that the former New York City Mayor falsely accused of trying to help steal the 2020 U.S. presidential election for Democrat Joe Biden.

The #SCOTUS has ORDERED he be returned to the US! The fact that he is not here means SCOTUS just hold every single one of them in CIVIL contempt which is NOT pardonable! #civilcontempt #doj

Appeals court hears debate over use of civil contempt and Snapchat evidence
Defense lawyers argued a sentencing court improperly used civil-contempt procedures in a criminal case to keep jail-credit days "open," while the Commonwealth defended the civil-contempt practice and urged that a Snapchat video and its banner text were admissible as an excited utterance.

1. Civil contempt does not require Federal law enforcement officials to serve papers.

2. Civil contempt cannot be pardoned by Trump.

I wish the DC police had not already helped DOGE. DC Police should serve warrants; DC Jail should hold contemptors.
The constitutional crisis is here.

The President is disobeying lawful court orders. His advisors and allies are cheering him on. And Kilmar Abrego Garcia remains trapped in a jail in El Salvador.

4/Abrego Garcia’s case is separate from the ACLU’s challenge to the Trump admin’s deportation of two planeloads of men under the Alien Enemies Act. In a hearing Friday in that case, Judge Boasberg considered whether to hold the Trump administration in contempt. He said they acted in “bad faith.”

Time for the courts to impose civil contempt confinement on DOJ leadership, and refer DOJ attorneys to the local ethics boards for intentionally advancing arguments and positions not consistent with the law or the rules of court.

Maybe then they'll comply.

I'm told the threat of jail can do that.
April 15, 2025 at 2:27 PM
They can uphold civil contempt orders from district courts finding executive branch officials, up to and including cabinet officials, in contempt until court orders are followed.

Yes, they can be held until they comply. No, they cannot be pardoned for civil contempt.

Yes, this is scary as hell.

You are correct, mostly because Trump could immediately pardon any criminal contempt charges, having the pres parden power. Civil contempt is where this would apply. A better breakdown than I would ever attempt to do -

If the Marshals Go Rogue, Courts Have Other Ways to Enforce their Orders
Opinion | Even a rogue marshal’s service is not an insurmountable obstacle to courts enforcing the rule of law.

Just learn that this is a thing. Apparently the courts can enforce contempt orders without the need for federal marshals though it has never been done before.

Maryland State Police can arrest them on a court order of civil contempt. They should start with the attorneys and Pam Bondi.

Civil contempt? The government can make infinite money.
Criminal contempt? Trump pardons.

So maybe you sanction Ensign. He's obviously going to get MAGA help during the sanction and after. So you'd need to disbar. But does this change the direction for the plaintiff or for our government?
April 15, 2025 at 2:20 PM
He can only issue pardons for criminal contempt (which is used for punishment), not civil contempt (which is used to compel compliance): "The distinction between [the two] is critical."
April 15, 2025 at 2:19 PM
Judges have been trying HARD to avoid having to send people to jail for contempt, but honestly, it's FAR past the point it was reasonable to pretend to believe "I know nothing, can't answer nothing, national security, above the law" bullshit is a reasonable answer on a civil rights matter.
April 15, 2025 at 2:19 PM
The best use of civil contempt would be to hold the US Gov in contempt, and impose a daily fine to be paid to the persons this action harmed until there is compliance.

And/or, jailing the highest ranking official responsible for this action until they either resigned or there was compliance (Noem).
April 15, 2025 at 2:18 PM
The judge has the ability to:

1. Hold the U.S. Government in Civil Contempt,

2. Impose Daily Fines,

3. Structure those fines to compensate the harmed party.

So— Judge should hold US Gov in contempt with a fine of $1M per day, and compensate the man's family— $1M per day!

Trump's head will spin.

I may be a realist but ALSO a dreamer…

I believe the courts have tools that they can use to put the brakes on all this. And I think El Salvador prisons may be where they’ll make radical moves.

Court sanctions can include imprisonment & I don’t think a presidential pardon applies🤔

Trump’s clash with the courts raises prospect of showdown over separation of powers
The Trump administration has been pushing back against certain court rulings it doesn't like in the hundreds of cases filed against it in the past few months.
