I think the general rule of thumb with nintendo legally is if they think it'll hurt their bottom line, theyll kill it, if not they dont really care (some good examples would be like the entire wii u, 3ds, and wii homebrew scenes & their online restoration projects, ctgpr & 7)

Ah yes CTGPR for Mario Kart Wii! Also adds in hundreds of user-created custom tracks both recreations of retro tracks and entirely original concepts. Just be aware that the competition is stiff and very strong there
