One agent shot Martinez, with evidence presented to the court that he later bragged about in text messages.

This, from the WaPo Edit Board is genuinely stupid. It makes it sound like "dismiss[ing] a majority of the country as biased, ignorant or otherwise basely motivated" is some political no-no. This dismissal is precisely what Trumpism is! Their movement seems to be doing really well!

5. While views diverge on the theoretical limits of judicial review under Rule 48(a), actual practice appears more consistent. There are relatively few cases denying a motion to dismiss under Rule 48(a) altogether without appellate reversal, and those cases involve prosecutorial harassment or the need to protect a defendant from suffering prejudice. See, e.g., United States v. Weiss, 1993 WL 77285 (S.D.N.Y. Mar. 12, 1993) (“deny[ing] leave to the government to dismiss the [] indictment” under Rule 48(a) based on court’s “conclu[sion] that [the] defendant [wa]s entitled to a decision on his pending motion,” which, if granted, “would have a res judicata effect on any subsequent government effort at prosecution”). Conversely, courts of appeals have often reversed and even mandamused decisions denying leave to dismiss altogether based on more amorphous considerations, such as a view that the evidence is sufficient to proceed. See, e.g., Rice v. Rivera, 617 F.3d 802, 812 (4th Cir. 2010) (per curiam); In re United States, 345 F.3d at 453. And “no appellate court has upheld a denial of a motion to dismiss, where the defendant has consented to the dismissal, grounded on a finding of ‘bad faith’ or action ‘contrary to the public interest’ alone.” United States v. KPMG LLP, 2007 WL 541956, at *6 (S.D.N.Y. Feb. 15, 2007).

The feds also included this footnote about a video that appears to contradict an account given to the judge of the shooting of Demond Edwards:
11 Indeed, the government moved so quickly to dismiss the complaint that the government itself did not appreciate the full context of the video and how it fit into the events that transpired that day. Specifically, the video in question captures approximately the last 25 seconds of the encounter between the TFO and Edwards prior to the shooting. Of course, the interaction between the two lasted for minutes and those earlier interactions leading up to the video, including Edwards striking the TFO, were not captured by that video, or other videos. As such, although the motion to dismiss described the video as “appear[ing] inconsistent with the description in the Affidavit,” the video, of course, does not present the entirety of the interaction between the TFO and Edwards, which remained unknown at the time, but has since become known to the government based on the extensive work the government has done since then.

Judge Mizelle spent several months writing her order granting our motion to dismiss and today responded to the government's request for clarification with a pretty clear "I spent months writing and editing to ensure I was extremely clear in the first place"
So, to charge two separate violations for “intentionally intercept[ing]” an electronic communication and a wire communication, the government must allege that two separate interceptions occurred. I do not read the indictment—or the brief description of the planned superseding indictment—to allege as much. All allegations by the government of interception support the view that Burke allegedly acquired the contents of each “audio/video” stream in a single act using the same wire, cable, or other system.
