The *only* thing to be said in favour of the lenders is that the regulator, the FCA, had (unbelievably) said "Yeah, that all seems fine." And approved the practice.
But if you know any law originating in the old Chancery courts, and the lenders lawyers clearly didn't, you'd spot a problem.
