John Roberts has created “immunity” as this thing that can be tossed around. If Iranian soldiers are defending themselves they commit no crime. If they have committed war crimes, Americans can’t “immunize” them.

Just breathtaking corruption. The justices found a way to immunize an aspiring autocrat while maintaining (barely) plausible deniability that this isn't exactly what they're doing.
Remember that DOJ sought expedited review of this issue from the Court last year (skipping the circuit courts). They refused and punted it to the DC Circuit, which took months; then dilly dallied all this time after the DC Circuit’s decision, before finally issuing a grant. It’s pretty transparent.

i think that the people claiming "the Court was always going to immunize Trump" are failing to distinguish that from "the Court would immunize Trump if failing to do so would leave the Republicans without a candidate in the 2024 election."

As I write here, it's totally incoherent to immunize the president from prosecution on the theory that he can be held accountable through the political process — and then to suppress the information that might allow Congress and the public to actually hold him accountable.

As I write here, it's totally incoherent to immunize the president from prosecution on the theory that he can be held accountable through the political process — and then to suppress the information that might allow Congress and the public to actually hold him accountable.
The logic of this argument is quite literally "The executive can immunize itself from any redress for crimes by committing additional crimes."

You can't blame Garland or Jack Smith for not being able to predict that the Supreme Court would immunize trump and cancel both of his trials. Nothing either could have done would overcome that.
