#institutionaliz
A wonderful story! When it really shows how one person can change the world.

My only worry now is that this administration wants to re-institutionaliz people with disabilities and mental issues.

Thank you for another story!👍💙🔆

Nothing was seized. A settlement, a fund rescinded by letter, a dismissal and a 50 to 49 confirmation vote are each ordinary legal forms. The mechanism is not that the law was broken. It is that the law was hired.
The State Was Not Captured. It Was Retained.
The phrase in circulation is mafia state: fiefdoms, a boss, loyalty in place of law, corruption not as a scandal but as the operating system. The paper trail is duller than the metaphor, and worse. It is a settlement no court ever tested, a fund rescinded by letter, a ten billion dollar lawsuit against a newsroom, a subpoena of a reporter that sits under seal, and the President's own criminal defense lawyer confirmed 50 to 49, on a Saturday morning, to run the Justice Department. Institutionalized corruption does not arrive by decree. It arrives by retainer. An autocrat seizes the state. A client retains it. The distinction matters because seizure is visible and retention is billable, one produces tanks in the street and the other produces filings, and every filing below checks out individually while the pattern they make does not appear on any single page. ## THE GAP ### The Frame in Circulation The term is the political scientist Bálint Magyar's, coined for Hungary in Post-Communist Mafia State (2016) to describe a regime run as a political family, with the state's institutions as its property. The pattern it names has been documented for the United States most carefully by the historian Ruth Ben-Ghiat, who has spent a career on how strongmen govern through personal loyalty. She is a professor of history and Italian studies at New York University, an adviser to Protect Democracy and the author of Strongmen: Mussolini to the Present. In her Lucid newsletter the pattern runs through three institutions at once. Journalists and activists who might expose theft are jailed or smeared, pardons tie their recipients to the leader, and "purges of the judiciary result in a justice system that exonerates crooks or doesn't prosecute them at all." https://lucid.substack.com/p/corruption-and-authoritarianism The frame is right about the shape and it still undersells the finding. Undersells, because a mafia state sounds like something that happens to a country, a seizure, an aberration, a thing with a beginning that can be photographed. What the documents show is quieter. Nothing was seized. Every instrument described below is an ordinary legal form, a settlement, a motion, a pardon, a confirmation vote, a civil complaint, each one individually defensible, and the coverage of each has treated it individually, which is exactly how the pattern stays out of frame. The mechanism is not that the law was broken. The mechanism is that the law was hired. ### The Justice Half, Dated Todd Blanche defended the President in his criminal cases. He was then confirmed as Deputy Attorney General, the department's day to day chief. https://www.justice.gov/dag/bio/deputy-attorney-general-todd-blanche In May 2026, as acting head of the department after Pam Bondi was pushed out, Blanche signed a settlement of the President's suit against the Internal Revenue Service over the leak of his tax returns, Trump v. Internal Revenue Service, 1:26-cv-20609 in the Southern District of Florida, the docket this publication's own tracker watches. https://www.courtlistener.com/docket/72207870/trump-v-internal-revenue-service/ The settlement document is posted by the department itself. https://www.justice.gov/opa/media/1441201/dl Two features of that settlement deserve to be read slowly. First, on 18 May 2026 the department announced a 1.776 billion dollar Anti-Weaponization Fund flowing from it, compensation for what the administration deems weaponization, with the department declining at the time to rule out payments to January 6 defendants. https://www.justice.gov/opa/pr/justice-department-announces-anti-weaponization-fund Second, the settlement barred future IRS audits reaching the President, two of his sons, and his company, an audit shield created not by statute or regulation but by contract, signed by his own former defense lawyer acting for the other side. At his 15 July 2026 confirmation hearing for Attorney General before the Senate Judiciary Committee, the fund and the settlement were the center of the questioning, including from Republicans. https://www.judiciary.senate.gov/committee-activity/hearings/the-nomination-of-the-honorable-todd-blanche-to-be-attorney-general-of-the-united-states Two of them, John Cornyn and Thom Tillis, withheld their votes until 2 August, when Blanche provided what their offices called a legally enforceable document terminating the fund and confining the audit settlement to the parties to the suit. https://www.tillis.senate.gov/2026/8/cornyn-tillis-announce-agreement-with-blanche-on-anti-weaponization-fund-irs-settlement On 8 August 2026, at seventeen minutes past four in the morning, the Senate confirmed him 50 to 49, every Democrat opposed, joined by Susan Collins and Lisa Murkowski. It is Roll Call Vote 230, nomination PN1078, and the Senate's own record reads Nomination Confirmed (50-49), with one senator absent. https://www.senate.gov/legislative/LIS/roll_call_votes/vote1192/vote_119_2_00230.htm https://www.npr.org/2026/08/08/g-s1-137631/senate-confirms-todd-blanche-attorney-general Around that spine, the department's enforcement discretion moved in one direction, and both moves are on the docket. On 14 April 2026 the United States Attorney for the District of Columbia, Jeanine Pirro, asked the D.C. Circuit to vacate the seditious conspiracy convictions of the Oath Keepers leadership, Stewart Rhodes, Kelly Meggs, Kenneth Harrelson and Jessica Watkins, because "the United States has determined in its prosecutorial discretion that dismissal of this criminal case is in the interests of justice," a filing of 506 words for convictions that took a two month trial, with a parallel motion for the Proud Boys leaders the same day. https://storage.courtlistener.com/recap/gov.uscourts.cadc.39855/gov.uscourts.cadc.39855.01208840665.0_1.pdf https://www.pbs.org/newshour/politics/doj-moves-to-erase-seditious-conspiracy-convictions-of-oath-keepers-proud-boys-in-jan-6-cases The court granted it on 21 May, vacating the judgments and sending the cases back for dismissal with prejudice. https://storage.courtlistener.com/recap/gov.uscourts.cadc.39855/gov.uscourts.cadc.39855.01208852352.0.pdf On 18 May 2026 the Principal Associate Deputy Attorney General, R. Trent McCotter, moved under Rule 48(a) to dismiss the bribery and securities fraud indictment against Gautam Adani, four days after the New York Times reported the plan. Judge Nicholas Garaufis granted the motion on 10 August and dismissed the three fraud counts with prejudice, in a 47 page order that records Adani's 13 November 2024 pledge to invest 10 billion dollars in the United States, finds "the irregularities in the decision to dismiss the Indictment are concerning," and answers McCotter's suggestion that the indictment was political with one sentence: "McCotter's baseless assertion is unbecoming of his office." https://storage.courtlistener.com/recap/gov.uscourts.nyed.522760/gov.uscourts.nyed.522760.49.0.pdf Before any of it, the President pardoned Changpeng Zhao, the Binance founder who had pleaded guilty to failing to maintain an effective anti money laundering program, while the Zhao family's crypto ventures did business with the President's own. The pardon attorney's own clemency list dates the grant to 21 October 2025. It was announced two days later, on 23 October, which is the date most accounts carry. https://www.justice.gov/pardon/clemency-grants-president-donald-j-trump-2025-present https://www.pbs.org/newshour/amp/politics/trump-pardons-binance-founder-changpeng-zhao Set the two halves of the ledger side by side. Financial defendants with the right lawyer or the right business relationships received dismissals and clemency. The department's new indictments ran toward the President's named antagonists. That asymmetry is what the published piece in this series called the two blades of discretion, and the point here is narrower and later: as of 8 August, the hand holding both blades belongs, by Senate confirmation, to the man who was until recently paid to defend the person the asymmetry benefits. ### The Media Half, Docketed The press side of the pattern is not a theory either. It is three live dockets, all of them on this publication's watch. Trump v. British Broadcasting Corporation, 1:25-cv-25894 in the Southern District of Florida, is a sitting President's ten billion dollar defamation suit against a foreign public broadcaster. https://www.courtlistener.com/docket/72040010/trump-v-british-broadcasting-corporation/ On 17 August 2026, entry 129 on that docket read: ORDER OF REASSIGNMENT to District Judge Jeffrey T. Kuntz for all further proceedings. Judge Roy K. Altman no longer assigned to case. No press release, no motion by either side, no stated reason. The person who decides everything that follows changed, and the only public record of it is one line in a docket. American Broadcasting Companies Inc. v. Federal Communications Commission, 1:26-cv-02902 in the District of Columbia, was filed on 18 August 2026, a broadcaster suing its own regulator, which is the license as leverage question in its most direct form, the state suing the press seen from the other side. https://www.courtlistener.com/docket/74661956/american-broadcasting-companies-inc-v-federal-communications-commission/ And in the Eastern District of Virginia, the New York Times and the Reporters Committee for Freedom of the Press have applied to unseal the judicial records surrounding a grand jury subpoena of the reporter Matthew Cole, 2:26-mc-00005. The subpoena of a journalist exists; the public record of it is closed, which is why the application exists. On 18 August the court granted the visiting lawyers' appearances, so the fight over opening that record is live this week. https://www.courtlistener.com/docket/74652738/in-re-application-of-the-new-york-times-co-reporters-committee-for/ Sue the newsroom, lean on the license, subpoena the reporter under seal. That is the media half of the pattern the frame describes, and none of it required a censorship law. Each instrument is a civil complaint, an agency proceeding, a grand jury process, ordinary forms doing extraordinary work. ### The Honest Version What this piece does not claim: that any document connects these actions as a coordinated program. No memo on file says media first, then justice. The mafia state characterization is an interpretive frame from a political scientist and a historian, not a finding from a record, and this piece uses it as a lens, not as evidence. The counterweights are also on the record, and a version of this piece that omits them is easier to write and easier to dismiss. A federal court threw out the charges against Kilmar Abrego Garcia as vindictive, citing Blanche's own public statements, which means the judiciary is still imposing costs on the prerogative when it can see it. Two Republican senators extracted a written, enforceable rescission of the fund before they would vote, which means a 50 to 49 chamber still prices misconduct. And on the same June day the Supreme Court handed the President removal power over independent agencies, it refused, in Trump v. Cook, to extend that power to the Federal Reserve, holding that a for cause removal is reviewable and that the governor was entitled to notice, evidence, and a chance to respond. https://www.supremecourt.gov/opinions/25pdf/25a312_5468.pdf The system is not finished. The direction is documented; the completion is not, and the difference between those two claims is the difference between this piece and a column. ## ROOT ### The Dual State, 1941 The precise description of what the documents above show was written eighty five years ago by a lawyer who watched it happen from inside. Ernst Fraenkel practiced in Berlin through the 1930s and published The Dual State in 1941, arguing that the regime he had just escaped was not lawless but double: a normative state that kept enforcing contracts, property, and procedure for those inside the circle, running alongside a prerogative state that acted without legal restraint against those outside it. The genius of the arrangement was that the normative state never stopped working. Business went on, courts sat, filings were stamped, and every person who pointed at the functioning legal system as proof that nothing had changed was telling the truth about the part of it they could see. Read the May settlement with that lens. An audit shield for one family, created by contract and defended as enforceable even after the fund built on it was rescinded, is normative state paper, contracts honored, precisely Fraenkel's point. The indictments running toward the President's antagonists are the prerogative. The two do not contradict each other. They require each other, because the contracts are what make the prerogative look like business as usual. ### The American Instances on File This series has already documented the same mechanism in domestic form, and the library carries the citations. Humphrey's Executor v. United States, 295 U.S. 602, decided 27 May 1935, made the independent agency possible by holding that the President could not remove an FTC commissioner except for cause. It held for ninety one years and was overruled on 29 June 2026 by Trump v. Slaughter, No. 25-332, which held that statutory tenure protection is no longer a constitutional bar to removal at will for the heads of independent agencies exercising executive power. https://tile.loc.gov/storage-services/service/ll/usrep/usrep295/usrep295602/usrep295602.pdf https://www.supremecourt.gov/opinions/25pdf/25-332_new_geil.pdf Slaughter is the removal unlock: after it, who runs an enforcement agency is a question the President answers alone, which is why a confirmation like Blanche's settles more than one office. And Shelby County v. Holder, 570 U.S. 529, decided 25 June 2013, remains the cleanest American instance of the underlying method. The Court struck the Voting Rights Act's coverage formula and left section 5 standing, so preclearance became inoperative without being repealed, and everyone who said nothing was taken away was telling the truth about the text. https://supreme.justia.com/cases/federal/us/570/529/ The statute survives, the instrument dies, the defenders point at the statute. That is the shape of the IRS settlement, the shape of the fund's rescission by letter, and the shape the last piece in this series found at the CFPB. What is new in August 2026 is not the method. It is the personnel: the method is now administered, at the Justice Department, by counsel. ## THE COUNTER MECHANISM The live lever is the one that just worked. Between 15 July and 2 August, two senators of the President's own party converted their committee votes into a legally enforceable document terminating a 1.776 billion dollar fund and confining the audit shield to the named parties. The rescission is dated, public, and posted by the senators themselves. https://www.tillis.senate.gov/2026/8/cornyn-tillis-announce-agreement-with-blanche-on-anti-weaponization-fund-irs-settlement A 50 to 49 confirmation margin means any two senators hold that lever for every future nomination the department needs, and the record now contains proof that it moves. What the record does not yet contain is a bill number codifying the rescission into law. Two bills touching the fund were introduced before the confirmation and neither does that job. S. 4791, filed by Charles Schumer on 16 June 2026, would abolish the fund outright and was read twice and referred to Judiciary. https://www.govinfo.gov/bulkdata/BILLSTATUS/119/s/BILLSTATUS-119s4791.xml H.R. 8955, the Bipartisan Transparency for American Taxpayers Act, filed by Brian Fitzpatrick on 21 May 2026, would prohibit federal funds from paying claims submitted to it, and sits in House Judiciary. https://www.govinfo.gov/bulkdata/BILLSTATUS/119/hr/BILLSTATUS-119hr8955.xml Abolishing a fund and defunding its claims are both prospective. Neither writes the 2 August rescission into statute, and nothing filed since 8 August does either, so the fund's death still rests on a letter signed by the man it was extracted from. The second live proceeding is the unsealing application in the Eastern District of Virginia, where the record of a grand jury subpoena of a reporter is being pried open in public, docket 2:26-mc-00005, orders entered as recently as 18 August. https://www.courtlistener.com/docket/74652738/in-re-application-of-the-new-york-times-co-reporters-committee-for/ That case is the pattern running in reverse, the press using the normative state's own machinery to force the prerogative into the open, and its outcome will say something measurable about which state is winning. ### At the Reader's Scale The machinery the Times is using is not reserved for the Times. The Freedom of Information Act is open to, in the government's own words on its own portal, generally any person, United States citizen or not, and the request has only to be in writing and to reasonably describe the records sought. There is no initial fee. Agencies usually charge nothing for the first two hours of search time or the first 100 pages of duplication, and a requester who can show that disclosure contributes significantly to public understanding of government operations, and is not primarily commercial, can ask for the remaining fees to be waived. https://www.foia.gov/faq.html Which agency matters more than the wording. Requests go to the office that holds the records rather than to a central desk, and the portal lists them. https://www.foia.gov/agency-search.html The fund rescinded on 2 August was Treasury business, the settlement addendum was the Department of Justice's, and both departments run their own FOIA offices with their own logs. A request that names the office and the document is the same lever the reporters used, run by somebody with no newsroom behind them. Two honest limits. Agencies process in order of receipt and backlogs are long and documented, so this is a lever with a long handle rather than a fast one. And the exemptions that shield an ongoing investigation are the same exemptions that shield a prerogative act from view, which is the difficulty this piece is about rather than a reason not to file. The frame says the government has been retained. The record says the retainer is not permanent. It was renewed 50 to 49 on a Saturday morning, in writing, with conditions extracted first, and a thing that must be renewed in writing can be declined the same way, the next time the paper crosses the desk. ## Further Reading Bálint Magyar, Post-Communist Mafia State: The Case of Hungary, Central European University Press, 2016. Supreme Court Launches Initiative to Address Backlog of Oldest Cases
Chief Justice of India (CJI) Surya Kant has introduced a structured docket-management initiative to expedite the resolution of the Supreme Court's oldest civil and criminal cases. The move, implemented on July 13, 2026, involves four dedicated benches that will exclusively handle approximately 800 long-pending matters. These benches, comprising two civil and two criminal divisions, will operate on non-miscellaneous days to focus solely on legacy litigation. The initiative aims to institutionalize the systematic disposal of old cases, which have often languished due to changing judicial rosters and competing urgent matters. CJI Kant emphasized that the judiciary's primary obligation is to deliver justice within a timeframe that maintains public trust in the legal system. The National Judicial Data Grid (NJDG) reports that the Supreme Court currently has 95,911 pending cases, with 37,826 of them being over a year old. The new system allows these benches to devote three working days weekly to legacy matters, free from the regular burden of miscellaneous hearings. This reform aligns with CJI Kant's broader administrative focus on improving judicial efficiency through targeted docket management rather than relying solely on judicial strength. The initiative also complements his advocacy for alternative dispute resolution methods like arbitration and mediation to address the national backlog of over 50 million cases.
