The IPP11 backdoor also enables intelligence agencies to get and use the data under IPP11(1)(g) “disclosure of the information is necessary to enable an intelligence and security agency to perform any of its functions”.

How can we fix this?

Submissions should recommend several measures:
1) Delete 65ZF(3) from the bill, so IPP11 does not apply

2) Minimising data retention, by deleting 65ZF(5) and stating data must be deleted no later than 30 days after collection.

3) Create an offence for misuse of the data

IPP11(1)(e) means the data collected by congestion charging schemes can be used if "the disclosure of the information is necessary to avoid prejudice to the maintenance of the law”.

The govt may claim this is necessary for enforcement, but it's not as enforcement is already a permitted purpose.
