In short, this admin is trying to erase a key DEFAULT method of getting a green card for over a half a century by taking the word "discretion" in the law and trying to turn it into a loophole big enough to effectively end a process Congress expressly permitted by law.

Congress passed a law specifically designed to protect victims of domestic violence who cooperate with law enforcement from being deported. ICE is breaking the law by deporting her. ICE is not a law enforcement agency.

This goes beyond sports and applies to all consular applications for visitor, immigrant, and nonimmigrant visas. Combined with the broader guidance, this will subject people who are gender nonconforming to extra scrutiny and potential denial of applications based on appearances.

There's also a fairly conscious effort by low and middle class nonimmigrant whites to avoid the appearance of striving (bc thats how rich white Americans appear from the outside), but that backfires into poorer outcomes

Deleted these two posts because we now have confirmation from the State Department that this suspension is limited ONLY to immigrant visas — visas which let someone enter the United States with permanent residence status and on a path to a green card. There is NOT a suspension on nonimmigrant visas.

Not possible. They can revoke nonimmigrant visas or DHS can place a permanent resident in rescission or removal proceedings. State can't revoke a green card.

Victims of certain crimes in the U.S. can obtain lawful permanent residency (a Green Card). This is primarily through the U nonimmigrant status (U visa), which is available to individuals who have suffered substantial physical or mental abuse. If you record the crime, they have a fighting chance.

Out of the 39, Nigeria is also the country most heavily impacted by the ban on non-immigrant visas. Excluding the COVID years, from FY 2015 to 2024 an average of 128,000 Nigerians were granted nonimmigrant visas each year. These were primarily tourist and student visas, which are now barred.

The EO didn't bar children of permanent residents, but applied to anyone present on a nonimmigrant visa. So that could include the child of parents here on H-1B visas who'd been living and working here legally for a decade, or children of foreign students studying for years.
I know they may not be thinking too deeply, but if this passed, did they really foresee people being born of permanent legal residents who nevertheless would be denied citizenship? How many generations?

I still do not understand how ICE could have designated her for expedited removal. Under ICE’s own, unlawful policy memos re expedited removal, a nonimmigrant visa holder CANNOT be placed in expedited removal - and Congress agrees. Moreover, she was still in a valid nonimmigrant status.

It's appalling for many reasons, including formatting and writing skill.

If you are currently abroad and on a valid H-1b visa, starting Sunday you'll be barred from re-entering the U.S. - unless you or your employer pay $100,000 to the U.S. government.
This de facto travel ban will cause chaos throughout tech and the entire economy.
