Not quite but it’s not dissimilar. (Fig 1 is the bag, figs 2-9 are the cover of the Goldeneye game, N’s copyright reg for the packaging, several N registered marks, the non-renewed Raresoft R mark, and the ESRB T for Teen mark.)
Question 1 (Essay) (50%) You are outside counsel for Nintendo. It's Monday morning and Nintendo's chief counsel calls you in a frenzy. "Have you checked your email?!? This is an outrage. I can't believe they did this - what can we do?" Turning to your email, you see a photo attached to an email from the counsel. (See image in the materials attached.) "Some marijuana dispensary has completely ripped off our IP! I want them sued into the ground - Nintendo is a family-friendly company, we can't allow our properties to be associated with drugs!" You promise to provide him with potential options later that day. An hour later, your paralegal provides you with a number of potentially relevant registered copyrights and trademarks. (See Figs. 2-9 in the materials attached.) Given the short timeframe, they can't promise that there aren't other registered rights; however, until you locate those rights, they must be considered to be unregistered rights (at best). Draft a memo to your client outlining legal and business strategies that Nintendo could employ, analyzing the potential infringements at issue as well as any defenses that the dispensary might be able to assert. To the extent that multiple IP rights are subject to fundamentally the same analysis, you may analyze them as a group. Bear in mind that Nintendo treasures its reputation as a family-friendly company and has historically refused to engage in markets and marketing it considers immoral or scandalous.
