Sandie Peggie loses another tribunal case. Had she won, the RCN would have been monstered across the front pages of the Times, Mail, Express, Telegraph, Sun and Guardian. Her loss will be relegated to the inside pages of those newspapers, while her costs are covered by her anonymous private donor.

She wasn’t “gender critical” she just had an issue with someone because they were trans.
So she lost.
(She would also have lost anyway. It’s all conspiracy theory nonsense.)

![119. The Tribunal concluded that SF did not understand the claimant to be asserting or manifesting a protected sex realist/gender critical belief, and did not perceive her views as anything more than disagreement about the use of changing facilities. The only information available to him was the brief note of the claimant's previous discussion with RCN Direct, and what she told him during their discussion. The claimant did not tell RCN Direct, or SF, that she had a philosophical belief that biological sex is real, important, immutable and not to be conflated with gender identity. She did not refer to holding gender critical or sex realist beliefs (as she was unaware of these terms at the time). She simply stated that she felt uncomfortable that a trans doctor, BU, was using the female changing area and did not feel that BU should do so, referring to a recent news story about Isla Bryson when doing so. The information provided to SF did not convey that the claimant held a philosophical belief, rather than simply an opinion or viewpoint, based on a recent news story. In cases of direct discrimination, which involve consideration of the mental processes of the alleged discriminator, it is a prerequisite that the alleged discriminator was aware of the protected characteristic. The protected characteristic cannot be the grounds for the treatment if the alleged discriminator is not aware of it (McClintock v Department for Constitutional Affairs 2008 IRLR 29, EAT).
As stated by Lord Justice Underhill in Maistry v British Broadcasting Corporation [2014] EWCA Civ 1116: 'The starting point is that since this is a claim based on discrimination what matters is what motivated the various individual colleagues and managers who were responsible for the acts complained of... The Tribunal was, therefore, unquestionably right that if the individuals in question were unaware that the Applicant held the philosophical belief in question they could not be motivated by that fact or, there…](https://cdn.bsky.app/img/feed_thumbnail/plain/did:plc:627r27mbqfcr3ajzctpfs4gw/bafkreibyvufobm3mdsipbtimszci26b4lo65h6e5onbxkc7wqugpbukxqm)

Even with all of JKRowling’s wealth (here I’m assuming her money was behind this case) the racist and transphobic nurse, Sandie Peggie and her supporting barrister Naomi (let’s face it she didn’t pick this job up under cab rank rules) Cunningham lose case against the RCN.
