Understanding Nuclear-Powered Data Centers: Key Considerations for US Developers The United States currently has two primary pathways for licensing new nuclear power plants. One pathway, outlined in 10 CFR Part 50, entails a standard, multi-step process. This process begins with an application for a Construction Permit (CP), which serves as the first step towards obtaining approval to construct and operate a new nuclear power plant. Following the issuance of the CP, the applicant must then submit an application for an Operating License (OL). This two-step approach provides a clear and established framework for developers seeking to build and manage nuclear-powered data centers. The alternative pathway, also governed by 10 CFR Part 50, involves a single-step process where the applicant files a comprehensive application that encompasses both the Construction Permit and the Operating License. The approval of this combined license grants the operator authority to begin construction and operation of the facility without the need for separate permits. This streamlined approach can be attractive to developers seeking to speed up the licensing process. Understanding these two pathways is crucial for US developers looking to establish nuclear-powered data centers. By grasping the intricacies of each licensing process, developers can navigate the complexities of regulatory requirements more effectively and make informed decisions about their projects.
