C) The Doctrine itself was only permitted in Red Lion v. FCC due to the scarcity of radiowaves issue. SCOTUS even noted that the FCC admitted that scarcity wasn't an issue, it never would have created the Doctrine.

While the mitigation of reduced attack surface is still a strong one, if it is sufficiently boutique in nature, scarcity of analysis becomes a weakness.
