Agreed. At bottom, SCt rules 7-2 saying no more removals of anyone under AEA until SCt has the chance to decide what "due process" is req'd under the Const. Kavanaugh concurs as I read him solely to make clear he thinks SCt should just decide all the merits Qs now (w/o sending back to CA5 first).
HUGE. A direct rebuke to the Trump administration's practice of shoving people onto planes: "Under these circumstances, notice roughly 24 hours before removal, devoid of information about how to exercise due process rights to contest that removal, surely does not pass muster."

Why it is not tenable for the SCt to simply defer to POTUS on whether there's an "invasion" under the Alien Enemies Act, a "rebellion" under s12406, or for that matter an "emergency" under IEEPA. Per CJ Roberts, the SCt is "not required to exhibit a naiveté from which ordinary citizens are free.”

Wow how much turns on presumption of regularity a/k/a whether SCt gives any credence to stmts by counsel. Govt both promised to appeal the merits so SCt would have any chance to decide it & (roughly) says it's still govt practice (sorta) to comply w/lower cts pending decision of SCt. Buy it?

Let's be clear in reporting this. SCt expressly overrules (yet another) landmark precedent in Humphrey's Executor that has been the basis of American federal governance for nearly a century.

MD SCT: "that's...not how linear time works..."
Md SCT: The government can't use data about an area being a high-crime neighborhood to help justify a stop if the officer didn't know of the specific data when he made the stop. If it was learned later, it can't be part of the suspicion calculus.

This new EO is a doozy, clearly written to test the constitutionality of independent agencies at the SCt. It purports to effectively bring all independent agencies - including the Fed Election Cmsn and the Fed (in part) under presidential control. Irreconcilable w/existing law full stop. /1

This new EO is a doozy, clearly written to test the constitutionality of independent agencies at the SCt. It purports to effectively bring all independent agencies - including the Fed Election Cmsn and the Fed (in part) under presidential control. Irreconcilable w/existing law full stop. /1
Campaign finance reform ( a reformed/expanded SCt can revisit Citizens United), DC statehood, independent redistricting, legis protection for DOJ independence, etc
