I do not believe that they have. The use of fraud-on-the-market as a theory of liability is novel outside of securities and commodities trading on federally regulated markets.

more generally, i cannot communicate how nuts this is. it's a strict liability offense and musk does not deny he did it (you either filed the paper or you didn't; he didn't)

I do not know how these companies are not committing ongoing securities fraud by not disclosing an $850 billion liability.

The AI doesn’t have agency, the humans do.

OpenAI engineers created a software system that illegally hacked government databases and software systems. They should be prosecuted and face civil liability to the fullest extent of the law.

Once again, software does not “go rogue,” as it has no intent or agency. OpenAI’s management and employees, however, have both, and are where investigations for liability should immediately begin.

It should be illegal. Prediction markets are are the bastard child of gambling and securities fraud — it reeks of fraud — and “insider trading” within prediction markets should be a criminal offense and give rise to civil liability.
