We've had some questions about the omission of the furlough pay provisions in the recent shutdown notices. Here's language you can include w/signature acknowledging the new notice that ensures you aren't waiving your rights.

#yourworkmatters #bettertogether #holdtheline #nffestrong #UnionsMatter
If you and your colleagues received a follow-up furlough notice that omits the wording about getting repaid after the shutdown ends, employees may want to respond back with some version of the following: “Acknowledged receipt of furlough notice dated 31OCT2025. I understand that I am being placed in a furlough status due to the lapse in appropriations. However, I note that this notice omits the standard statement regarding retroactive pay under 31 U.S.C. § 1341(c) and the Government Employee Fair Treatment Act of 2019, which provides that both furloughed and excepted employees are entitled to receive back pay at their standard rate after the lapse ends. My acknowledgment of this notice does not waive any rights or entitlements under applicable law.”

We met with the agency National Leadership Council (NLC) . NLC is moving all employees out of excepted (work with no funding) to exempt (paid with non appropriated funds) . All exempt employees will be paid with carryover funding nationally for now. That funding should last 1-2pay periods . Once spent funding will depend on units' available funds such as: JobCorp is funded through DOL for the next year, Perms and Trust, Cost Recovery, GAOA, IIJA, IRA, and Disaster funds. http://www.NFFE.org & https://www.nffe-fsc.org We met with the agency National Leadership Council (NLC) . NLC is still deciding how to handle Rx Burning nationally. The OMB guidance says the agency "may" RxBurn,so NLC is trying to develop the sideboards of when we can RxBurn. .We asked if they knew anything about potential RIFs or terminations. As news headlines were saying, NLC was originally expecting to see RIF notices come out simultaneous with furlough notices. Since that did not happen there is no telling if we will see them moving forward in ouragency or not. http://www.NFFE.org & https://www.nffe-fsc.org Wemet with the agency National Leadership Council (NLC) . We told them NFFE FSC notices and are thankful for their efforts to ensure as many employees as possible are in exempt/paid status. . We informed them about the safety issues the banners on our websites seem to be creating for some of our frontline staff. We encouraged the NLC to inform the agency of this risk, and at minimum recommend that employees be aware of potential disgruntled public at admin sites and to work in pairs/groups especially with employees who are helping maintain developed rec sites when they do not normally do so as part of their job. http://www.NFFE.org & https://www.nffe-fsc.org

Funding lapses at 12:01 eastern if Congress doesn't act. #ourworkmatters #yourworkmatters #unionstrong nffe-fsc.org/shutdown
NFFÉ If the shutdown happens: 1 Report to work as usual Wednesdav for an "orderlv shutdown"(AL will be canceled) unless the Forest Service informs you in writing that you are officially furloughed. Otherwise you risk an unexcused absence if you are not furloughed. 1a) Work devices will need to be secured at the office if you are not classified as "essential/exempt " take them all in tomorrow eg hotspots, laptops, tablets, radios, agency vehicles & their keys. 2) follow us on socials: insta @nffe _fsc, fb @ForestserviceCouncil, bluesky @nffe-fsc.bsky.social. 3)Sign Up for NFFE alerts using your personal email. Follow NFFE on insta @nffe_ union, Fb @NFFEunion, and BlueSky @nffe.bsky.social 4) Review your personal finances and prepare for the possibility of delayed paychecks. Reach out to banks, utilities and loan servicers to see what their process is going to look like- last time most worked with our emplovees. Regularly visit the NFFE-FSC website and NFFE-FSC on Facebook for news and updates! http://www.NFFE.org & https://www.nffe-fsc.org Things to consider: 1) file an interim travel voucher if you are on a fire during this. 2) turn in leave requests for use or lose so they can be officially denied, this allows the leave to be reinstated if you don't get to use it. 3) update your timesheet(s). 3) stay within a 24hr call back range unless you have pre- approved leave. Given flight times, this doesn't limit your cheap beach options much. http://www.NFFE.org & https://www.nffe-fsc.org What we have on good authority: 1) Folks working on priorities eg timber, minerals, and fire are going to be "essential*." 2) RX burns are canceled 3) Depending on the nepa project, appeal/objection review teams will be "essential" *Essential (Syn exempted) means working but not getting paid until a budget is passed. Plan accordingly for commuting and daycare costs! We got the 2019 Government Employee Fair Treatment Act passed. NFFE fought hard to pass the 2019 Government Employee Fair Treatment Act. This ensures that all furloughed employees will receive their backpay retroactively upon the government reopening. No more hoping Congress would vote to backpay us! http://www.NFFE.org & https://www.nffe-fsc.org

NFFE LEGISLATIVE ACTION ALERT (red act now button) Federal employees that began their career as seasonal or temporary employees are not able to contribute the requisite number of years to draw full retirement benefits after 30 years of service. These dedicated workers then face a choice: leave the federal service without full retirement benefits or work longer than their peers to obtain their full retirement benefits. The Federal Retirement Fairness Act would allow former seasonal and temporary federal employees to "buy-back" retirement contributions in order to retire after 30 years of service.

One less thing to worry about this weekend- U.S. District Court Issues Injunction Halting Implementation of Large-Scale RIFs nffe.org/nffe_news/u-... #bettertogether #unionstrong #nffestrong #unionsmatter #yourworkmatters
Internal NFFE News May 23, 2025 Late Thursday night, the U.S. District Court for Northern California issued an injunction that halts the Trump Administration from implementing large-scale reductions in force (RIFs) at most federal agencies. The order extends and replaces the court’s original temporary restraining order that expired yesterday. The court found the plaintiffs, which include multiple federal sector unions, local governments, and nonprofits, are likely to succeed based on the merits of their claims challenging Executive Order 14210 and the Trump Administration’s RIF directives. The court argued the RIF plans were ordered by the White House, not independently directed by agencies, thus violating the separation of powers. As a result of the court opinion, the Trump Administration is indefinitely barred from implementing large-scale RIFs and agency reorganizations during ongoing litigation of the case. The court also found the plaintiffs had legal standing to bring forth the case based on job loss, diversion of resources, and disrupted public services. The order applies to the departments of Agriculture, Commerce, Energy, Health and Human Services, Housing and Urban Development, Interior, Labor, State, Treasury, Transportation and Veterans Affairs, in addition to OMB, OPM, DOGE, AmeriCorps, Peace Corps, the Environmental Protection Agency, the General Services Administration, the National Labor Relations Board, the National Science Foundation, the Small Business Administration and the Social Security Administration. “This is yet another favorable decision for labor unions challenging the Trump Administration’s careless attacks on federal workers and our public services,” said NFFE National President Randy Erwin. “The President directing mass layoffs is dangerous and unlawful, and the courts agree. NFFE and our allies are confident the rule of law will prevail, and these reckless actions by the President will continue to be shut down.”

Red banner over a capitol building photo reads: NFFE LEGISLATIVE ACTION ALERT with a red ACT NOW button. The text reads: Recently, the House Oversight and Accountability Committee advanced a series of deeply harmful proposals targeting federal and postal employees. Passed on a party-line vote (except for Rep. Mike Turner (R-0H-10), these measures would force public servants to foot she bill for tax breaks for billionaires and corporations. If included in the upcoming budget reconciliation package, these proposals would: • Raise FERS retirement contributions to 4.4% for all federal and postal employees. .E Eliminate the FERS supplement for retirees under age 62. • Cut retirement benefits by shifting annuity calculations from the high-3 to the high-5years. Force new hires to choose between being At-will or paying a 9.4% FERS rate-a 5% Pay cut for job protections (which is illegal). Charge a $350 fee to access the Merit Systems Protection Board. These proposals are reckless, unfair, and punitive. Take action now: Write your Members of Congress and tell them to oppose any Legislation that includes these anti-worker provisions. Federal workers and the wellness of the country should not be used as a piggy bank to fund tax giveaways for the wealthy. The blue landing page on action network where the headline reads "Tell Congress Hands Off Federal Employees' Retirement and Merit Protections" There is a bargraph indicating 2759 letters have been sent so far. The current goal is set to 3200 letters. The challenge "take action" is issued at the bottom.
