"What worries me most is the false sense of security these systems create. If someone is told to wait 48 hours during an asthma attack or diabetic crisis, that reassurance could cost them their life." In one of the simulations, eight times out of 10 (84%), the platform sent a suffocating woman to a future appointment she would not live to see, Ruani said. Meanwhile, 64.8% of completely safe individuals were told to seek immediate medical care, said Ruani, who was not involved in the study.

On Thanksgiving, the immigrant children held at the Dilley detention center gathered in the gym for what they thought was a holiday feast.

The kids salivated over a spread of turkey, sandwiches, pastries and pies, a family told me.

But the food wasn’t for detainees — it was for the staff.
On Nov. 16, a mental health counselor recorded in Kamilla’s medical records that her mother reported the girl had lost her appetite after being “served food that contained worms.” A week later, the couple said, children were told to gather in the gym for what they believed would be a Thanksgiving celebration. Excitement spread as families saw tables set with turkey, sandwiches, pastries and pies, they said. The children waited expectantly. But when a parent asked when the celebration would begin, Oksana said, staff told them the holiday meal was for employees, not detainees. The children, she said, watched despondently as the feast was packed away.

MINUTE ORDER. The Court has reviewed the Government's 126 Motion to Stay the Court's Order Granting Relief Under 5 U.S.C. § 705 and 127 4 Plaintiffs' Motion to Set Briefing Schedule. The Government took three business days from the Court's decision to file the motion. They now ask the Court to rule within one business day and three hours and do so without identifying any basis for this rushed timetable. Due to the serious issues presented in this litigation, Plaintiffs should be afforded at least the same amount of time as the Government to brief their opposition. At the hearing on the Government's Motion, the Court expects the Government to articulate, among other things, how the irreparable harm and other stay factors weigh in the Government's favor. The Government contends that the Court "intru[des]... in the workings of a coordinate branch of the Government." Dkt. 126 at 22 (citation omitted). But missing is any concrete example of how the Court does so. This failure is particularly problematic in light of the Government's representations that it was "remote conjecture," "speculation," and "theoretical" that it would detain or initiate removal proceedings against Haitian nationals if the Termination went into effect. Dkt. 92 at 42; see Dkt. 126 at 23-24. Either the Government does not have any concrete plans to detain and initiate removal proceedings against Haitian TPS holders if the Court stays its decision pending litigation and therefore its own irreparable harm argument is suspect. Or the Government does have such concrete plans and therefore its argument that Plaintiffs will suffer no "irreparable harm" is suspect. So that the Court has all relevant information before it, it ORDERS the Government to submit a sworn declaration from a senior member of the Department of Homeland Security which states what steps, if any, DHS has taken in the expectation of the February 3, 2026, Termination (now stayed) going into effect. Specifically, the declarant must state whether DHS has taken any actionand, if so, which actions)to mobilize members of Immigration & Customs Enforcement to areas heavily populated with Haitian TPS holders, such as Springfield, Ohio, and South Florida. If the Government has taken no action in anticipation of the Termination, the declarant must state that. The Court ORDERS Plaintiffs to respond to the Government's Motion by February 11, 2026, at 12 p.m. It further ORDERS the Government to file the above-described declaration on or before February 10, 2026, at 10 a.m. The Court will hold a motion hearing February 12, 2026, at 10 a.m. Signed by Judge Ana C.
