This also pretty much ensures the execution does not occur on the scheduled date. A District Judge will absolutely issue a stay and then eventually we’ll get to see if the Supreme Court overturns Wilkerson after 150 years.

People quite often choose to move to a state for tax reasons. If the state changes its tax laws, the new laws apply to you. If you don’t like them, you move.

That’s not contractual reliance. Alito is specifically invoking the reliance theory of contract.

With your example, you could say that about any number of things, and if that constrained legislative or judicial action, then the basic principles of governance would be vitiated.

Also lawyer-brained and it does. Marriage is an actual contract entered into by individuals, dissolvable only by court order, and one’s economic life is planned in reliance on the validity of said contract.

The right to an abortion is quite different.
