ediscovery just got a whole lot worse
For the nonlawyers - without looking, I'm going to guess that this will be a document-heavy case (if it survives a motion to dismiss). One where the vendor costs for ediscovery will run five- to six-figures.

Former law firm Director of Ediscovery here. The idea that the *FBI* is using bottom-of-the-professional-barrel Adobe for legal discovery is mind-blowing. Actual professionals use actual, certified ediscovery software to redact documents, even small firms.
This is weapons-grade incompetence.

Even if you are not paying for fees and costs - by the way, eDiscovery vendors aren't cheap, and a good eDiscovery platform and support can be key - this is not going to be fun. It will be invasive. Like a visit to the doctor invasive, and I ain't talking about primary care. We're talking -oscope.

There's really nefarious about the DOJ's production pipeline or document numbering.
These are fairly common complications one runs into when dealing with large FOIA or eDiscovery dumps. I had to normalize the docs and compare them with the automatic Bates numbers stripped out of the analysis.

I thought they already paid massive overtime to redact the files back in March. Redacting "thousands of pages," especially using modern ediscovery software wouldn't take much time at all. This sounds like nonsense (or an excuse not to release everything).

At this point they have everything...it's too late, we're fucked. There is eDiscovery software that will download millions of documents and categorized them into concepts or special searches in 60 minutes.

I’m most confused by why someone in that situation would feel the need to lie. He started in forensics before there were degrees in it. He had plenty of time to get adequate certifications in ediscovery over the years.
