The judgment should help the many organisations which have got themselves into a legal mess by caving in to activist demands to operate self-ID policies. It means hospitals can no longer tell female patients they are transphobic if they object to a male medic who identifies as female doing an intimate exam. Employers can’t expect women to share changing rooms with male colleagues. Sporting associations can’t jeopardise fairness and safety in women’s sports by allowing male athletes to identify into them. Lesbians can run associations that exclude anyone male. Male police officers identifying as female still strip search women In a different world, employers and organisations would have embraced the practical consequences of this ruling by calmly and sensitively setting out what it means for those they oversee. No hope of that, though, in a reality defined by a leadership vacuum on sex and gender. Some executives have superficially welcomed the judgment while studiously avoiding talking about its consequences. Others have resorted to hyperbolic outrage, misrepresenting it as a rollback of trans rights rather than the law as it’s always been: a delicate balancing act. #TransAgendaClips

The Darlington Memorial Hospital colleagues brought a claim against County Durham and Darlington NHS Foundation Trust after Rose Henderson, a biological male who identifies as a woman, was allowed to use the facilities. In a judgment handed down yesterday, employment judge Seamus Sweeney ruled the NHS had violated the nurses’ dignity and the trust’s conduct amounted to harassment. He said allowing the sharing of changing facilities created a “hostile, intimidating, humiliating and degrading environment”. The judgment has intensified pressure on Bridget Phillipson, the women and equalities minister, to bring in guidance that would ban transgender women from using female-only changing rooms. Bethany Hutchison, president of the Darlington Nursing Union, who led the claim against the Trust, told “It is very simple, Bridget Phillipson needs to publish the lawful EHRC guidance now. There has never been a valid reason or excuse for delay and after today’s ruling there definitely is not now.”
