Here DOJ argues that the Arch isn’t a “building,” either. (Under the Height of Buildings Act, buildings in DC are generally limited to 130 feet.) DOJ cites a dictionary definition that appears to refute its own argument: “building” means “that which is built …”

![The Arch is not a "building" under the HBA.
The HBA applies only to "buildings." See 36 Stat. at 454. Contrary to Plaintiffs' assertions,
the Arch is not a "building" as the term was defined in 1910. Tellingly, Plaintiffs omit the following italicized language from the 1913 dictionary definition of "building," "[t]hat which is
built; a fabric or edifice constructed, as a house, a church, etc." Compare TRO Br. 26 with Webster's Unabridged Dictionary at *1646 1913), https://archive.org/details/2976582. The use of
"house" and "church" to define "building," demonstrates that the term encompassed edifices that shelter the activities occurring inside, as distinguished from other structures. A free-standing Arch is more like a monument, tower, or sculpture than a "house" or a "church." The Arch does not exist to shelter activities occurring inside-much like the Washington Monument does not exist to
shelter activities inside, even though it contains an elevator and viewing areas.](https://cdn.bsky.app/img/feed_thumbnail/plain/did:plc:vrmx2e5gsi23srsy2n7vljvb/bafkreih5byzbf5fg3sgz5q336de5ndmxpn46f2msnsiaij5gqs2f2wgpjy)

KUALA LUMPUR: The National House Buyers Association (HBA) says homebuyers need more than proof of regulatory compliance, calling for a developer performance profile and early-warning system to help buyers assess risks before committing their life savings. A housing developer may be licensed to sell homes, but that does not necessarily mean it has the financial strength, technical competence or track record to deliver them, said HBA honorary secretary-general Datuk Chang Kim Loong.

Now that I'm (finally) getting close to wrapping up the rough draft for HBA2, I'm getting excited about the next two HBA books.
Books I cannot start playing with until after I get HBA2 revised, edited, and published. And finish the Vampire Gifts series. Can't forget Cadi and co. 😅
