An unnamed immigration judge in Colorado found a noncitizen was a danger by just writing "danger" in her order. Senior Judge William Martínez ordered release because 1.) one word is not a legal analysis and 2.) the immigration judge ignored (or not, who knows) the dismissal of the man's DUI case.
The IJ “expressly found that Mr. Mendoza Hernndez was not a flight risk.” (Id. at ¶ 31.) The IJ explained, “I don’t believe that the Respondent is a risk of flight. But I do think he’s a danger, and I am gonna be denying bond, based on 2024 and 2026 [sic] too close together in time for me to not find a danger.” (ECF No. 3-4 at 11; see ECF No. 1 at ¶ 31.) The IJ denied bond in a written one-word order: “Danger.” (ECF No. 3-5 at 1; see ECF No. 1 at ¶ 32.). risk of erroneous deprivation. The Court agrees with Mendoza Hernandez that the IJ’s one-word bond order is patently deficient on its face. It is wholly bereft of any analysis whatsoever. Even the IJ’s oral ruling is unclear as to what specific evidence the IJ relied on to base her decision. Mendoza Hernandez takes issue with the IJ’s failure to conduct the individualized, forward-looking assessment required for custody redetermination hearings under 8 U.S.C. § 1226. Because the IJ failed to conduct any individualized assessment, Respondents have circumvented their constitutional obligation to provide a “strong special justification” for Mendoza Hernandez’s detention. Santillan Quiroz, 180 F.4th at 1249. rue, as the IJ noted, the DUI case was dismissed after the date the Form I-213 was created. (ECF No. 3-4 at 4.) Even so, the DUI case was dismissed by the date the IJ held the hearing. Whether intentionally or by negligent oversight, the IJ should not have blinded herself to the uncontroverted fact the DUI case had been dismissed without any determination of culpability on the part of Mendoza Hernanez whatsoever. Although it was acceptable for the IJ to have considered the misdemeanor offense, she utterly failed to explain why the misdemeanor offense, whose sentence and all attendant court-imposed requirements had already been completed, demonstrated that Mendoza Hernandez was a danger to the community. After all, Mendoza Hernandez submitted hundreds of pages of exhibits refuting DHS’s argument that he was dangerous. The IJ’s failure to consider the fact that the DUI offense attributed to Mendoza Hernandez was dismissed undercuts the due process concern with accuracy. The IJ clearly erred in denying bond by predicating her decision on the DUI case, without any reference to the fact that the case was ultimately dismissed and that Mendoza Hernandez never pleaded guilty and was never convicted. And though the IJ also relied on the misdemeanor offense, for which Mendoza Hernandez completed the sentence, she provided no reasons as to why that offense would show he was a danger.

Correction to the above: the IJ did adopt the argument, based on authority holding that statements in a Form 1-213 should be presumed to be accurate.
After considering the information provided by both parties, the Court concluded that no bond was appropriate in this matter. The Court first reasoned that the Respondent failed to meet his burden of demonstrating that his release from custody would not pose a danger to others, as the evidence shows that he is a verified member ofMS-13. Matter ofSiniauskas, 27 l&N Dec. at 210; Matter of Adeniji, 22 l&N Dec. at 1111-13; 8 C.F.R. § 1003.19(h)(3).

I once pointed out a blatant error on a 213 for no reason other than to dunk on the idea that DHS documents are reliable and prepared carefully and accurately. Little mistakes, big ones, “mistakes” and yet the IJ is supposed to take as Gospel what DHS stands by, and ignore incompetence or worse

An (unnamed) immigration judge relied on a largely false arrest form and the fact that a man resisted ICE agents--who by all appearances seemed like they would kidnap him/his wife/his children--to deem him dangerous and a flight risk. Magistrate Judge N. Reid Neureiter of Colorado released him.
Petitioner states that the I-213, which was the only evidence DHS submitted, “was not signed, was not otherwise authenticated, and contained so many errors and inconsistencies as to render it unreliable.” ECF No. 13 at 5. The motion lists the catalogue of inexplicable mistakes: For example, the I-213 incorrectly states that Mr. Bonfil Rivera is “not married” and “does not have children,” but he is married with two U.S.- citizen children. Compare Ex. 1 with Ex. 2. The I-213 also inconsistently states: that he is both “30” years old and “32” years old (he is 31 years old); that the Officers were wearing “highly visible ‘ICE’ markings” (but see Ex. 2 at 9); that his first name is “Jesus” (it is Alexis); that there both was a warrant “signed by a supervisor” (which he was never served with and was never filed with the immigration court) but simultaneously that he “was likely to escape before a warrant could be obtained;” that he “re-entered the United States” without permission after previously being in the United States (not true); that his last names are “Zarate Rueda” (they are Bonfil Rivera); that he “has no immigration petitions or applications pending or approved (he has an approved I-130 petition and an approved I-601A waiver application); and that he claimed no fear of persecution if returned to “Colombia” (he is alleged to be a citizen of Mexico). Id. at 5–6 (footnote omitted). These inconsistencies are troubling; indeed, the IJ stated, “[Y]ou certainly give me concerns in regards to some of the information on there, and I’ll be giving it the weight that I deem necessary based on whatever the next testimony is.” ECF No. 17 at 4. However, the IJ’s decision does not attempt to resolve—does not even address, in fact—any of the numerous and obvious irregularities. This is especially significant because the IJ relied on this evidence in support of her conclusion that, was dangerous and a flight risk. She did so in the face of—not only the I-213’s “concerning” discrepancies—but also Petitioner’s rebuttal evidence, which included: statements that immigration officers (1) followed him in an unmarked car for hours while his wife and young children were in the vehicle, (2) chose not to arrest him when he exited his vehicle at a Denver Police precinct, (3) were not wearing any clothing to identify them as immigration officers—only “Police,” (4) were not identified as Immigration officers when they stopped his car by pulling in front of him and cutting him off, and (5) shouted at him, in English, a language he did not understand, that they were going to use a taser on him if he did not get out of the car. See Ex. 2 at 2. Mr. Bonfil Rivera drove to the Denver Police precinct out of fear that he was being followed and did not know who was following him. Getting no help from the Denver Police, he returned to his vehicle, where Immigration officers continued to surveil him and could have easily arrested him there while he was outside of his vehicle. Instead of acting at that time, officers damaged Mr. Bonfil Rivera’s vehicle by destroying the driver’s side window of the vehicle’s door. They damaged his shirt when they ripped him out of the vehicle, to the horror of his spouse and young daughter. And most critically, at no point did Mr. Bonfil Rivera make any attempt at eluding or fleeing the officers. He simply did not understand what they were shouting at him. See Ex. 2 at 2. other serious traffic offenses. These old convictions, standing alone, cannot establish dangerousness. Mau v. Chertoff, 562 F. Supp. 2d 1107, 1118 (S.D. Cal. 2008) (government did not establish dangerousness, as a matter of law, by pointing only to past DUI convictions that were four to six years old). The IJ’s decision also refers to a 2023 conviction for disturbing the peace, but the record before the Court offers no other information about that charge and the IJ does not describe what happened, making it impossible to assess its seriousness. Nor does the IJ explain how dismissed criminal charges could constitute clear and convincing evidence that Petitioner is a present danger to the community, and the Respondents do not address this question in their response. Under these circumstances, the Court finds that IJ failed to comply with this Court’s order directing that the Respondents bear the burden of justifying Petitioner’s detention by clear and convincing evidence.

Magistrate Judge Cyrus Chung of Colorado ordered a new bond hearing before a different immigration judge after an unnamed IJ thought a noncitizen's (dismissed) misdemeanor assault charge was actually a violent felony and used it to deny him bond.
In the instant matter, the petitioner is entitled to a new bond hearing. First, the IJ’s conclusion that DHS proved the petitioner’s dangerousness by clear and convincing evidence relies on an inaccurate assessment of the facts, which cannot carry that burden. Clear and convincing evidence “requires a high degree of probability.” Glasscock v. Utah, No. 4:18- CV-4-DN, 2021 WL 1169862, at *6 (D. Utah Mar. 26, 2021) (quotation marks and citation omitted). It is “that degree of proof, though not necessarily conclusive, which will produce in the mind of the trier of fact a firm belief or conviction.” Matter of Patel, 19 I. & N. Dec. 774, 783 (1988) (quotation marks and citation omitted). Here, the IJ’s conclusion was based on the I-213’s notation that the petitioner was arrested for second degree assault, a violent felony. ECF No. 15-3 at 3. But that was inaccurate, as the petitioner was only charged with misdemeanor offenses. Moreover, aside from this inaccurate reference to the petitioner’s charges, there was no information in the I-213 regarding this alleged incident, such as a description of the underlying conduct. The IJ’s assumption that the petitioner “intentionally or recklessly caus[ed] injury to another by means of a deadly weapon” was based on her misunderstanding of the charges, not reliable information. Id. And critically, the charges were later dismissed.

Sure have…or at least I suspect. ICE picked up a bunch of roofers by surrounding the house. Said they were acting on a “tip” and the home owner let them do their thing. We tried to suppress but the IJ said “presumptively reliable” as a business record for the 213 and that was that.
