With Justice Department appeal to the U.S. Supreme Court in the case involving 20,000 ballots of allegedly "likely" noncitizens in California.

an important aspect of american politics is that it has a lot of litigation and even the non-litigation parts are litigation-shaped
November 2, 2026 at 9:21 PM
DOJ is now:

1-6 in district courts
0-2 in Circuit courts
0-1 in SCOTUS

The 1 win comes with this opening line by Judge Boasberg: "Even extraordinary merits questions cannot justify the extraordinary relief of a preliminary injunction or [TRO] if those seeking it lack standing." (DSCC v. Trump)

I wrote about this litigation, and the substantial disenfranchisement that the government’s claims would likely produce, in this morning’s “One First”:

The California voter roll litigation is a useful illustration of “election integrity” claims that would exclude far more eligible votes than ineligible ones.

For today's "One First," I wrote about the California voter roll litigation and the "base rate fallacy"—which, in the election context, manifests as the risk of disenfranchising a significant number of eligible voters in the course of hunting for a proportionally miniscule number of ineligible ones:

#ICYMI: I wrote about how the Trump administration's threats & litigation against California over claims that noncitizens are on the voter rolls perfectly illustrate the "base rate fallacy"—and the risk that we disenfranchise a large number of eligible voters in the search for a few ineligible ones:

It was an absolutely insane week in litigation involving the Trump administration.

I had to miss our weekly livestream due to travel, but my colleagues covered the golf course drama, election litigation, today’s Comey hearing, and more! ⬇️
At 4 pm ET, Benjamin Wittes will sit down with @mollyroberts.bsky.social @rparloff.bsky.social and @ericcolumbus.bsky.social to discuss developments in litigation against Trump administration’s policies on this week’s Lawfare Live: The Trials of the Trump Administration.

Similar to 2020, when the primary goal of the litigation was to create a pressure campaign and pretexts for Republican actors to act.
DOJ is now batting 0-6 in district courts and 0-2 in appellate courts in these 2026 Midterms Election Integrity Cases.

Judge Reyes: there is reason to believe that the current litigation hold is insufficient. Notes that prior witnesses testified that gov't business was being conducted on personal devices.

🗳️ TODAY IS ELECTION DAY 🗳️

Trump and his GOP allies have been working around the clock to file litigation aimed at making midterm voting more difficult.

Here's where their efforts stand on Election Day👇

Ehhh, I’m not talking less about the “regulate through threat of litigation” which is related.

I’m talking about regulating the general process, which does often touch on litigation (and there is a difference.). One is much more post Nader.

The litigation has gotten noticeably sloppier in the last month and a half or so. Which is saying something.
November 2, 2026 at 12:21 AM
It is is sort of insane making how many disasterous lib boomer brainworms are connected to This One Guy. Land use by endless litigation, ‘Neighborhood character’ lawsuits against apartments and transit? Nader? Opposition to nuclear power? Nader.
A few weeks ago I tried to explain to my students that the world of politics and regulation as endless lawsuits and interest groups is essentially the work of a single guy and that guy is still alive. I don't think they believed me.
The endless fucking lawsuits, and the veneration of the ability to file endless lawsuits, in lieu of policy. The institutional mindset of how you are simultaneously The Experts On Activism Who Must Be Listened To and also smol beans that you mustn’t dare criticize.
