You can also argue that one of the reasons her first trial turned out the way it did was because the prosecutor invoked the exact same misinformation that my partner was about what NGRI entails. And there's undeniably a racial element to that entire case.

Also relevance to the Lindsey Clancy case is the Latarsha Sanders case but she has luckily gotten a new trial. The Boston Globe did a really good breakdown of why she should have gotten NGRI. Be warned this is a rough read.

The history behind NGRI is also tied to Ronald Reagan in two separate ways. After John Hinckley was found NGRI while trying to assassinate Reagan there was a huge backlash towards it and it became significantly harder to use that defense.

He also repeated the assertion I hear a lot that NGRI gets overused but that is flat out not true. It's used in about 1% of court cases and it succeeds about 26% of the time.

Specifically he had a very incorrect idea about what it means if someone gets not guilty by reason of insanity or NGRI. The biggest misconception he had was if she was found to be NGRI at trial that she would walk out.

It's actually good news that there is no "rapist syndrome." You want these folks to be convicted and sentenced to jail, not diverted to hospitals as NGRI.

#LindsayClancy pleaded not guilty due to insanity. I personally am not the biggest fan of the #NGRI "lack of criminal responsibility" defense, but it does exist here in the USA, and it is not anything new. I will be suspending my judgement 🤔 and see how the ruling turns out

Did you know that neurodivergent people end up serving like five to six times more time locked up for the same crimes if they’re committed by others? NGRI pleas are bullshit.

Nullification is not a perversion.

In this case, the perversion was the 2016 Mass supreme court case inverting the NGRI standard and removing the burden shifting. That was nullified here and that's a good thing.
