I'll take this a step further and say that it is effectively impossible to fake your way through a NGRI defense. It is infinitely more likely someone who actually is NGRI is treated like a normal defendant than someone successfully faking it.

This is exactly the type of misinformation I am talking about re: the clancy trial.

Many news outlets are reporting as though the only options are Guilty and NGRI. But that is *not true*.

In MA, an NGRI plea does not absolve the state of their need to prove the act. Defense is arguing both fronts
Incorrect. They plead not guilty based on insanity. In Massachusetts you can’t do that and the prosecution has to argue the insanity defense.

The history behind NGRI is also tied to Ronald Reagan in two separate ways. After John Hinckley was found NGRI while trying to assassinate Reagan there was a huge backlash towards it and it became significantly harder to use that defense.

Specifically he had a very incorrect idea about what it means if someone gets not guilty by reason of insanity or NGRI. The biggest misconception he had was if she was found to be NGRI at trial that she would walk out.

Being found NGRI means that she'll be sent to a psychiatric facility for quite a long time. It may not be for the rest of her life but it'll be for years and years; she's not going to get to walk around freely

Also, like..... this is hardly the first time that "Not Guilty by Reason of Insanity" has been applied to a similar situation. Andrea Yates was found NGRI like 20 years ago in another high-profile case.

NGRI basically never works. you have to successfully argue a defendant couldn't tell right from wrong due to a specific mental illness, which is very difficult even in the most favorable circumstances because behavioral science just doesn't work like that

I don’t understand how anyone’s attorney allows them to pursue a not guilty by reason of insanity plea.

Did you know that neurodivergent people end up serving like five to six times more time locked up for the same crimes if they’re committed by others? NGRI pleas are bullshit.

If she's found NGRI, she'll spend several years (if not the rest of her life) in psychiatric care. She doesn't get to go home the day afterwards. I think what we do to defendants who succeed with NGRI pleas is almost as bad as what we do to those who fail, but I know for some people this matters

It's wild. What is even crazier is the number of people ignoring NGRI laws in MA. If a defendant enters a not guilty due to insanity plea in MA, then the burden is 100% on the prosecution to prove that she was sane, beyond a reasonable doubt.

Some supporters say NGRI & focus on the need for more support to pregnant & postpartum women.

And all the evidence we have suggests it's actually underused and there are a lot of people in prison who should have been able to plead NGRI and being in prison is just making them worse.

Did You Know?

that “insane” is not really a psych or medical term or any sort of diagnosis, it’s a legal term mainly only used in NGRI cases (Not Guilty by Reason of Insanity) which is very hard to get.
