A senior NHS official privately urged colleagues to add more patient data into a Palantir-built platform at the same time as he was being paid to advise the US technology company. Matthew Swindells has been joint chair of four major hospital trusts in north-west London since April 2022 and has also since then acted as an adviser to Palantir through the now-defunct lobbying firm Global Counsel, which was co-founded by Lord Peter Mandelson.

The health care board for one part of England, Greater Manchester, has repeatedly declined to adopt Palantir's FDP, choosing to stick with a home-spun platform developed over the best part of a decade. The board claims it doesn’t need Palantir, that its own platform is functionally superior and more trusted by the public. "[Even] a technically strong platform will struggle to realize value if clinicians, data controllers, patients or the public do not trust it," Matt Hennessey, chief data and analytics officer at NHS Greater Manchester, tells WIRED. "If we were to fully adopt the FDP … it would be a retrograde step." That claim—disputed by Palantir and other FDP advocates—has fed into a national debate over whether the government should seize an opportunity next February to terminate the NHS contract early, instead of allowing it to run until 2031.

The DPIA we reviewed stated that access to identifiable patient information would be limited to NHS staff with a legitimate need. However, since then, recent media reporting, and subsequent confirmation from the programme team, indicate that some external contractor staff also have access to identifiable patient information within the National Data Integration Tenant (NDIT) environment. We were not aware of this. We have therefore written to the programme to seek clarification on this inconsistency.

Government officials had argued that it was feasible to hand the running of the Federated Data Platform (FDP), which Palantir is contracted to build, to another provider, people familiar with the discussions said. They have begun quietly exploring the technical process of removing Palantir from NHS systems in advance of any decision to use the original contract's break clause in 2027. "We are confident we could do it if we wanted to," said a senior government figure. The official stressed that the assessment was not prompted by specific dissatisfaction with Palantir.

On April 16, MPs will debate the future of Palantir's NHS data contract. The Financial Times recently reported that government ministers have been seeking advice on triggering the break clause in Palantir's contract for the NHS Federated Data Platform – with one senior government figure telling the paper: "We are confident we could do it if we wanted to." This debate is a chance to keep up the pressure at a critical moment. A Westminster Hall debate can't vote to force the government's hand – but it does force a minister to listen and respond on the record. We know ministers and officials are already discussing what to do about Palantir behind closed doors. A packed chamber on April 16 will send a clear signal that MPs are watching closely – and that this issue isn't going away. Please email your MP today and ask them to attend this crucial debate. The more MPs who hear from their constituents before April 16, the more likely they are to show up – and the harder it will be for ministers to let Palantir's contract run on unchallenged.

Public trust and confidence There has been much interest in this statement. The intensity of interest and strength of public feeling on this issue appear to reflect not only how deeply many people care about the use of their data, and its confidentiality, but also continuing concern amongst some about Palantir's role in the NHS. This topic has always been to some extent political. As such, people have a range of views. And public, professional and media scrutiny has only increased over time. This means that accuracy and transparency must remain central priorities for the NHS FDP programme. This incident has shown how quickly confidence erodes if the "no surprises" principle (Caldicott Principle 8) is not upheld when it comes to who can access people's data, and why.

Martin Wrigley, MP for Newton Abbot, raised concerns about reports that identifiable patient data was flowing into the national FDP system and that Palantir engineers and others could obtain administrative access when required. Similar concerns were raised earlier this month by the NDG. Gill said: "Well, firstly, can I say I'm very sorry that happened. But nobody has access to the system without having a legitimate purpose and all access is time limited. "It's audited, you know who would have access, what they needed it for." The minister said the issue related to how access arrangements had been described in NHS England documentation rather than the access controls themselves. "There was an error by NHS England that meant that the Data Protection Impact Assessment that was referred to, NHS staff, rather than clarifying that actually the access was for authorised users and support staff," Gill told MPs.

The second dimension to the general discourse on FDP – the choice of supplier(s) to provision the FDP – is not a matter over which CDAOs have a say [although we believe as a general point that it is a missed opportunity to not have been more involved in the procurement as potential future users]. It is for NHSE to address any public concerns about procurement or its choice of supplier(s). However, public trust around the use of sensitive data is hard won and easily lost. This relationship of trust with our citizens requires constant and careful attention and we receive regular expressions of interest and concern about health data use including specifically the extent of our engagement with FDP and its supplier(s). We must take into consideration in the development of our local data assets and demonstrate responsiveness to these concerns if we are to safeguard and preserve this trust.

In a legal letter, the NHS has told us it is now planning to publish a new version within "two weeks". This new version will contain details of the clause which lays out how Palantir will protect personal data. And the NHS has also confirmed that it will release a version of its contract with the biotech company, IQVIA, to provide "Privacy Enhanced Technology" for Palantir's data platform. We're delighted that we've be able to shed some light on these shady deals. But it's not yet clear just how much of these contracts will be revealed. And the NHS warns that their commitment to publish within two weeks "should not be taken as a firm timeline".

The following caveat will be added to the main page of the FDP benefits and uptake website: NHS England publishes two types of benefits for operational products that are supporting patient care: 1. The first is a count of actions taken by local NHS users through products – for instance the number of records reviewed using the RTT product. 2. The second is a benefits calculation applied by NHS England to calculate the impact of an NHS FDP product on a local organisation’s operational performance. These are observational before/after comparisons showing changes to each metric following the introduction of the NHS FDP. For these observations, NHS England cannot draw conclusions about cause and effect as other variables have not been controlled for.

I ask the Minister to consider using the contract renewal point to stop the chaotic expansion of the Palantir platform monopoly, to work to a staged exit with a retender for British companies to build a replacement for Palantir, and to deliver a better, long-term solution providing British sovereign capabilities in line with principles outlined by the Science and Research Minister and the Prime Minister. The current contract delivers a subscription service that leaves no deliverables after the subscription—no software, no improvements and no intellectual property after spending more than £330 million. All the specially written software and intellectual property rights belong to the supplier, says the contract. All the rights to any know-how are explicitly retained by the supplier and not passed across on termination of the contract. The contract delivers no software—not one line—just a subscribed service; a permanent lock-in; a single point of failure.

Federated Data Platform - Canonical Data Model The Federated Data Platform (FDP) Canonical Data Model (CDM) is rooted in the logical CDM. The logical CDM represents and captures data across the NHS estate and helps to standardise data collected, stored, and disseminated by various platforms and products. This is being developed by the NHS and dictates the data structure for products developed in the FDP. The FDP CDM model is developed based on the logical CDM. Any alterations to meet performance or application requirements will be logged and reconsolidated with the model. Details as to how the logical CDM will shape its implementation on FDP will be published when the logical CDM is released. Any updates made to the FDP CDM will be published to the GitHub repository on a monthly basis. The intent is to expand the CDM aligned to products in current development. Proposed updates will be assessed to avoid the need for any breaking changes unless deemed absolutely necessary.

Another NHS official said they were called into a meeting last year with senior NHS England leadership and asked to explain what they were seeking to develop with one of their data programmes. "I was told 'the FDP will do that' and that they would talk to my boss to make sure I stopped work on the tool I was developing,” the person said. "It was a very real threat and I had colleagues tell me to 'watch yourself'." The first analytics official added: "When letters go out saying, 'Sign this or we’ll call your chief executive', that doesn't build goodwill. It creates compliance, not commitment."

If you did it in industry, it'd probably be around 50 per cent, but just getting 30 per cent of that resource to deployment was really tough. “And [deployment is] the first thing they want to cut because they don't understand that you're not just investing in technology, you're actually investing in the change and the business process to enable people to use and deploy that technology to do their day-to-day job."

Peter Frankental, Amnesty International UK's business and human rights director, said it was "shocking to see such attempts to wine and dine" Tang. He added that the revelation coming from an FOI request "underscores the fact that there needs to be proper transparency over how these contracts are awarded". NHS England's decision to hand Palantir the contract for the Federated Data Platform was controversial. Some NHS staff and medical trade unions had raised concerns about its suitability and privacy campaigners had voiced concerns about the technology company accessing patient data.

A group of NHS clinicians responsible for registries holding health information on millions of patients are warning of the risk of a major data breach through an NHS England project they claim has neglected basic IT security measures. The programme to set up an Outcome Registries Platform (ORP) has received little attention outside the NHS, but once complete, it will see over 30 clinical registries comprising disparate highly sensitive, special category datasets that currently are held separately, moved into a single centralised repository, with the aim of improving patient care. However, ORP is currently accessible via the public-facing internet, rather than being located on the secure Health and Social Care Network (HSCN), and is not protected by multi-factor authentication (MFA), which is stipulated by NHS security protocols.
