there is no jurisprudence at work here. the republican court believes that anything a republican president is presumptively constitutional, even if it directly violates the unambiguous constitutional text and causes total chaos in law and policy.

SCOTUS never shuts up about the proper judicial role in a system of separated powers. but the justices can't stand the idea that lower courts treat them like an actual court, whose opinions are binding only to the extent they're linked to the resolution of concrete cases.

Well the Court once again, as I predicted at 7:00 this morning, has abused its power by gutting the Voting Rights Act to allow people of color to be redistricted in ways that should be illegal and which greatly helps the GOP. #notacourt.

Yesterday, in the context of an emergency (there was none) motion with no argument and limited briefing, the Court overturned almost a century of precedent to just about end independent agencies. This is not how real courts behave.

After reflection it occurs to me there was no reason for SCOTUS to take the citizenship case and issue its ruling. We have had these injunctions for a long time and there were a bunch against Biden. Why now?
There’s only one answer.
It’s a Republican tribunal first and foremost-Full stop.
