After TX Attorney General Ken Paxton announced civil action against the Screwston Anti-fascist Committee in Houston, I requested internal communications about it. The OAG requested the records be exempt, citing an investigation into "potential violations of the Texas Deceptive Trade Practices Act."
The Consumer Protection Division ("CPD") of the OAG has a pending investigation into antifa- affiliated companies for potential violations of the Texas Deceptive Trade Practices Act. If violations are uncovered, CPD will initiate enforcement proceedings. Accordingly, the OAG anticipates litigation in this matter. The requested information relates to the anticipated litigation, and has not been seen or provided to all the respective parties involved. Accordingly, the OAG asserts the requested information be withheld from required public disclosure under section 552.103 of the Government Code. II. Conclusion The OAG respectfully requests a decision from the Open Records Division regarding the applicability of the argued exception as provided by the PIA.

Rashid Al Malik Mr. Martin: I appreciate the opportunity to advocate for the dismissal of the indictment against our client, Rashid Al-Malik. I had engaged earlier with Aakash Singh and, following his guidance, had further dealings with the remaining prosecutor in the EDNY. This email and the corresponding attachments include the information previously provided Mr. Singh with additional information on the recent engagement with EDNY. As you may know, Rashid was indicted along with the Chairman of President Trump's first Inaugural Committee, Tom Barrack, for allegedly acting as unregistered agents for the UAE in violation of 18 USC § 951 , and conspiracy to commit such violation. Mr. Barrack was also charged with seven additional counts of obstruction and false statements related to interviews he gave the FBI and the US Attorney's Office for the EDNY. (Attachment 1) Rashid, along with Mr. Barrack's personal assistant, Matthews Grimes, were collateral damage amidst the political weaponization of the Department against Mr. Barrack. After a two-month trial, Mr. Barrack and Mr. Grimes were acquitted - with jury deliberations lasting less than 12 hours. Despite these acquittals, and our repeated requests, the Department has not dismissed the case against Rashid. We met with the prosecutors in EDNY in October of 2023, and followed that meeting with a written request for dismissal and statement of reasons. (Attachment 2) Having no success with the AUSAs who had prosecuted Mr. Barrack and Mr. Grimes, we subsequently wrote to the EDNY's Chief of the Criminal Division and then-Chief of the DOJ's Counterintelligence a… espionage by foreign government actors." (Attachment 4). While dismissal of the case against Rashid is justified on the merits, I note that were the Bondi Memo in place in July of 2021 this case would not have been indicted as it would have violated Department policy. On April 21 , while in New York on another matter, I met with one of the remaining prosecutors, AUSA Ryan Harris, about the status of our request for dismissal. AUSA Harris explained that he had discussed the case with Interim US Attorney John Durham, who requested a written memo on the matter. AUSA Harris explained that he was in the process of preparing the memo and would be back in touch after the memo had been provided to the Interim US Attorney. Shortly thereafter, the Interim US Attorney was replaced by President Trump's nominee for US Attorney for the EDNY, Judge Joseph Nocella. I wrote AUSA Harris, once again, and he advised that he was not in a position to advise as to when the new US Attorney would be able to address the case (Attachment 5). Rashid has never been an agent for the UAE. He worked with Tom Barrack and supported President Trump. Since 2010, Rashid has sought to bring economic prosperity to the United States through a variety of real estate projects with investment from our Gulf Allies - exactly what President Trump has been undertaking. It should be noted that during Mr. Barrack's trial, prosecutors sought to portray the UAE as something less than an ally of the United States. Were a trial to proceed now, the remaining alleged coconspirators would be: [4 LINES (b)(6)].
