The use of the spyware came to light in 2022, with traces of Predator found on dozens of phones. The scandal led to the resignation of Greece’s intelligence service chief and the prime minister’s chief of staff.

The judgment also included an award of €7,000 in legal costs. The lawsuit concerned**posts published by Koukakis on X and statements he made in interviews about Greece’s wiretapping scandal**. Dimitriadis argued that _**the statements had harmed his personality rights, professional standing and future prospects, and sought €350,000 in damages.**_ In its reasoning, the court found that Koukakis had drawn on information available at the time, journalistic investigations and the findings of competent authorities. It said he had expressed opinions based on logical inference rather than arbitrary conclusions and had identified the sources of his information. The court also ruled that referring to Dimitriadis alongside businessman Yiannis Lavranos and former Intellexa executive Felix Bitzios as ‘protagonists of the wiretapping scandal’ was neither an extreme characterisation without basis nor beyond the limits of acceptable journalistic criticism. The judgment stressed that Dimitriadis, as a public figure, was required to show greater tolerance of journalistic scrutiny of his conduct. It also held that the phrase ‘godfathers of wiretapping’ did not exceed what was necessary. The court noted that Dimitriadis and Lavranos are linked through a godparent relationship. It considered the expression mocking, but not an instance of indiscriminate targeting, and found it justified by the existence of that relationship. During the hearing, the presiding judge reportedly challenged Dimitriadis’s legal team over why he had not sued the individuals allegedly involved in the surveillance operations while taking legal action against journalists. Zacharias Kesses, lawyer for Koukakis and other surveillance victims, said: ‘Now that Grigoris Dimitriadis has read the decision rejecting his claim, perhaps he will remember to do the obvious: bring civil and criminal proceedings against Tal Dilian, Sara Hamou, Yiannis Lavranos and Felix Bitzios, who used his mobile phone number through spoofing to target dozens of people, including the chief of the Hellenic Police and the prosecutor overseeing the National Intelligence Service (EYP). He should also take action against Tal Dilian over what he has stated publicly and set out in writing about the sale of Predator to the Greek security services during the same period in which Dimitriadis himself supervised EYP.’ Koukakis’s other lawyer, Giorgos Stamatiadis, said: > ‘The decision found that the disputed statements did not exceed what was necessary, did not contain extreme or indiscriminate characterisations and were not motivated by a specific intention to insult the claimant. Equally important is the court’s recognition that the journalist could not be expected to wait until lengthy investigations had been completed and their final findings published before informing the public. Η αγωγή του Γρηγόρη Δημητριάδη αναφερόταν σε δημοσιεύσεις του Κουκάκη στο Χ και δηλώσεις του σε συνεντεύξεις σχετικά με το σκάνδαλο των υποκλοπών. Ο Δημητριάδης ισχυρίστηκε ότι είχε προσβληθεί η προσωπικότητα, το επάγγελμα και το μέλλον του, ζητώντας αποζημίωση 350.000 ευρώ. Σύμφωνα με το σκεπτικό τους δικαστηρίου, ο Κουκάκης αξιοποίησε τα διαθέσιμα στοιχεία της περιόδου, δημοσιογραφικές έρευνες και πορίσματα αρμόδιων αρχών και διατύπωσε απόψεις μέσω λογικών επαγωγών και όχι αυθαίρετων συμπερασμάτων, παραπέμποντας στην πηγή των πληροφοριών. Το δικαστήριο έκρινε επίσης ότι η αναφορά στο όνομα του Γρηγόρη Δημητριάδη μαζί με εκείνα των Γιάννη Λαβράνου και Φέλιξ Μπίτζιου, με τον χαρακτηρισμό «πρωταγωνιστές του σκανδάλου των υποκλοπών», δεν συνιστά ακραίο χαρακτηρισμό χωρίς έρεισμα ούτε υπερβαίνει τα ανεκτά όρια. Όπως τονίζεται στην απόφαση, ο Δημητριάδης, ως δημόσιο πρόσωπο οφείλει να επιδεικνύει μεγαλύτερη ανοχή στον δημοσιογραφικό έλεγχο των πράξεών του. Το δικαστήριο έκρινε ακόμη ότι η φράση «κουμπάροι των υποκλοπών» δεν υπερβαίνει το αναγκαίο μέτρο, καθώς ο Δημητριάδης συνδέεται πράγματι με σχέση κουμπαριάς με τον Λαβράνο. Η αναφορά κρίθηκε μεν σκωπτική, αλλά όχι άκριτη στοχοποίηση, και δικαιολογημένη μια και η σχέση με τον Λαβράνο είναι αληθής. Σημειώνεται πως κατά τη διάρκεια της εκδίκασης της υπόθεσης, η πρόεδρος είχε αναρωτηθεί επικριτικά προς την πλευρά Δημητριάδη γιατί δεν έχει ασκήσει αγωγή στους εμπλεκόμενους ιδιώτες, ενώ κάνει αγωγή σε δημοσιογράφους. Ο δικηγόρος του Κουκάκη και άλλων θυμάτων των υποκλοπών, Ζαχαρίας Κεσσές, τονισε ότι ο Γρηγόρης Δημητριάδης «τώρα που θα διαβάσει την απορριπτική του απόφαση ίσως θυμηθεί να πράξει τα αυτονόητα. Να κάνει μήνυση και αγωγή κατά των Ταλ Ντίλιαν, Σάρας Χάμου, Γιάννη Λαβράνου και Φέλιξ Μπίτζιου, που χρησιμοποίησαν τον αριθμό του κινητού του μέσω spoofing για να παγιδεύσουν δεκάδες πρόσωπα, μέσα στα οποία ήταν ο αρχηγός της Ελληνικής Αστυνομίας και η εισαγγελέας της ΕΥΠ. Να στραφεί κατά του Ταλ Ντίλιαν για όσα δημόσια λέει και υποστηρίζει και εγγράφως, περί πώλησης του Predator σε ελληνικές υπηρεσίες ασφαλείας, την ίδια περίοδο που ο ίδιος είχε την εποπτεία της ΕΥΠ». Ο έτερος πληρεξούσιος δικηγόρος του Κουκάκη, Γιώργος Σταματιάδης, σημείωσε ότι «η απόφαση έκρινε ότι οι επίδικες διατυπώσεις δεν υπερέβαιναν το αναγκαίο μέτρο, δεν περιείχαν ακραίους ή άκριτους χαρακτηρισμούς και δεν υπαγορεύονταν από ειδικό σκοπό εξύβρισης σε βάρος του ενάγοντος. Κομβική είναι και η παραδοχή ότι ο δημοσιογράφος δεν όφειλε να αναμείνει την ολοκλήρωση των μακροχρόνιων ερευνών και την έκδοση των τελικών πορισμάτων τους πριν ενημερώσει το κοινό. Σύμφωνα με το δικαστήριο, η απαίτηση αυτή δεν συμβιβάζεται με την αποστολή του Τύπου, η οποία συνίσταται στην άμεση ενημέρωση για την τρέχουσα επικαιρότητα».
