Finally had a chance to write up the CJEU's Russmedia ruling which appears to make it literally *impossible* to run a website in the EU that allows any user content. I just don't see how compliance is possible. At all. Hat tip to @daphnek.bsky.social for calling it to my attention.

I'm pretty sure the CJEU in Russmedia just casually dismantled 80% of the DSA with one ill-considered judgment. As I read it, it substitutes in GDPR rules -- not notice and takedown rules -- for any platform where a user is likely to post content about people. 1/

I wrote up my concerns about the CJEU's Russmedia ruling. This is the first of two posts, it's about the bad results of relying on the GDPR (and displacing laws like the DSA) to define platforms' liability for content.

Es gab vor kurzem das EuGH-Urteil in Sachen Russmedia - die Ansätze aus dem Urteil könnten auch auf diesen Fall angewendet werden.

Nach Übernahme der Moser Holding durch Russmedia hält diese 77% an der neuen Medienholding, 23% gehören weiterhin der BTV Bank.

An der Tatsache, dass private Medien in Österreich reichen Familien, Banken & der Kirche gehören, ändert sich also nichts, nur eine der Medienmonopolregionen wird größer.

For my fellow Russmedia obsessives -- here is a follow-on case in Germany that was suspended at the BGH pending the Russmedia outcome. The facts and claim, seeking proactive monitoring, are bizarrely similar to Glawischnig-Piesczek.
