Tonight was unprecedented. The SCOTX has civil jurisdiction. The CCA has criminal appellate authority. Yesterday the House issued a subpoena for Roberson to appear. Today a district court issued a stay. AG appealed to CCA. Tonight, SCOTX said, the subpoena is a civil matter & stayed the execution.

Ken Paxton is so incompetent that in his suit he filed with SCOTX to have 13 Demcoratic seats vacant, he contradicts himself in the filing listing two different sets of 13.

Two weeks ago SCOTX told Texans to (1) get court authorization for abortions while in active medical crisis and/or (2) sue their doctors for negligence if they won't provide abortions.

Today, SCOTX said asking the court for an abortion authorization demonstrates that the abortion is unlawful.

Texas Lawyer here! Neither of those things are in the state constitution, which does nothing more than require a two-thirds quorum to conduct business. But SCOTX ruled in 2001 that it was their right to withhold quorum, which is a perfectly valid interpretation of the quorum requirement.

There's a famous Texas case about potential juror misconduct where the problem was that a juror was dating a Sheriff's Deputy, in a case about the Sheriff. It occurred to me to check if they ended up together after their relationship made it to SCOTX.

As part of THAT case, the Fifth Circuit asked SCOTx to clarify whether judges can be sanctioned or not. By changing the juidicial code of conduct, SCOTx appears to be saying "nope, you won't get in trouble in this instance." www.chron.com/culture/reli...

Many thanks to a friend for pointing this out, but SCOTX has apparently asked the Supreme Court Advisory Committee to study ending Texas's unusual pre-grant merits briefing.
