The U.S. Securities and Exchange Commission has closed its nearly four-year investigation into electric vehicle startup Faraday Future, despite staff recommendations last year to pursue enforcement action. Multiple sources confirmed the agency notified the company and involved parties this past week that no action would be taken against Faraday Future or its executives, including founder Jia Yueting. The probe examined potential false and misleading statements during the company's 2021 SPAC merger and allegations of faked sales of its first FF91 vehicles in 2023, raised by whistleblowers. Investigators issued subpoenas, conducted depositions of former employees and executives in 2024 and 2025, and sent Wells Notices in July 2025 signaling a preliminary intent to recommend charges related to anti-fraud provisions, particularly around related-party transactions and Jia's control over the company. Faraday Future cooperated extensively, spending significant resources, and expressed relief at being able to focus fully on business execution. This outcome is uncommon, as about 85% of Wells Notice recipients typically face SEC court action, according to a prior study. The decision aligns with a sharp decline in SEC enforcement against public companies in fiscal 2025. The Department of Justice had also requested information but has not confirmed a formal probe. Faraday Future, founded in 2014 by Jia amid ambitious plans to rival Tesla, has faced repeated financial struggles, board battles, layoffs, and shifts in strategy, including importing Chinese vans and rebranding efforts. The company recently received a Nasdaq warning over its stock price falling below $1. The closure follows similar SEC endings for probes into other EV SPAC startups like Lucid and Fisker.
