The impeachment tribunal spokesman, Atty. Regie Tongol, stated that the Supreme Court's recent ruling dismissing petitions against the Senate impeachment court's decision on the voting threshold for Vice President Sara Duterte's conviction has established a 'firewall' around the tribunal's independence. The Supreme Court En Banc dismissed petitions filed by former Executive Secretary Vic Rodriguez, Berteni Causing, and lawyer Ernesto Francisco Jr. on procedural grounds, including lack of standing and prematurity. The impeachment court had previously ruled that the two-thirds vote threshold for conviction should be based on the number of senators participating in the proceedings, rather than the total number of senators. Tongol emphasized that the Supreme Court's dismissal of the challenges confirms the impeachment court's proceedings are constitutionally sound and cannot be disrupted by premature judicial interventions. The petitioners had sought to halt the implementation of the ruling through temporary restraining orders or status quo ante orders, with Rodriguez arguing that the impeachment court effectively amended the Constitution by adding a qualification not found in its text. Causing and Francisco contended that senators who remain in office should be counted even if they are detained, in hiding, or medically unable to attend. The presiding officer, Senator Francis 'Chiz' Escudero, explained that senators who are detained, suspended, or medically incapacitated would be excluded from the count. Marcoleta is detained over a P75-million plunder case, Estrada over a P573-million plunder charge, and Dela Rosa has not appeared publicly since May 14 after authorities attempted to serve an ICC warrant. Senator Loren Legarda is on medical leave abroad due to a lung ailment. The impeachment court's ruling, which stands undisturbed, will continue to perform its constitutional mandate to solely try and decide the impeachment case without external distractions or unnecessary stalling.
