Context is US courts have ruled that standards organizations like the ICC lose their copyright on codes and standards once they are adopted into law, under the logic that you cannot copyright the law. ICC and others are trying to change that with the Pro Codes Act, which might make UpCodes illegal.

This part, on pgs. 25-26, caught my eye. Does it open the door to allowing UpCodes and others to publish code commentaries? They can be pivotal to understanding what the code (i.e., the law) actually means.
![It makes no difference that UpCodes copied "non-mandatory" portions of incorporated Works. In arguing that UpCodes has not justified copying non-mandatory portions, ASTM relies on a passage from ASTM I stating that the third factor "would weigh strongly in favor of finding fair use" if Public Resource limited its copying to material of "legal import," as opposed to material that "does not govern any conduct." 896 F.3d at 452. But the D.C. Circuit did not hold that copying the latter type of material was antithetical to fair use. See ASTM II, 82 F.4th at 1269. Standard A252 illustrates this point. The mandatory portion of the standard provides that "wall thickness shall not be more than 12.5% under the specified nominal wall thickness.

I would think that those minisplits in the second imagine would violate 306.1 of the mechanical code, which requires a 30”x30” level working space in front of the unit. (It should be allowed though, they do this in every other country.) up.codes/viewer/orego...

NYC’s building code allows you to use NFPA 13R up to six stories. NYC’s generally pretty good at standing up to the fire protection industry – we also do not require standpipes in non-high-rise buildings with fewer than 6,000 sq. ft. per floor. up.codes/viewer/new_y...

Note I'm only specifically commenting on fire code here, but those codes are very strict laws the hotel must follow. Not something the hotel made up. Room occupancy exist to ensure each room can be fully evacuated within a set amount of time. Fire doesn't care about time.
