This strategy addresses increasing demand from energy-intensive industries

As the demand for AI infrastructure continues to surge, data centers are increasingly turning to behind-the-meter (BTM) generation to meet their power needs, with investment firm Jefferies estimating that 25-33% of new data center power needs through 2030 will be met by these solutions. States such as Texas and PJM are actively promoting natural gas resources to attract data center developers, while major players like OpenAI and Equinix have already adopted BTM gas generation and fuel cells, driving a trend that could potentially account for a third of the data center market in the coming years.

A recent Texas law, SB 6, set to take effect in 2025, significantly updates the regulatory framework for large power consumers, particularly those using Behind-the-Meter or Front-of-Meter configurations, by increasing transparency, predictability, and financial accountability through stricter approval processes and reduced authority for the Electric Reliability Council of Texas (ERCOT). The law requires detailed system studies, financial viability assessments, and disclosures about similar projects and backup generation capabilities, while also imposing new requirements on developers to ensure compliance with Public Utility Commission of Texas (PUCT) rules and statutory thresholds.
