As a serving magistrate for 12 years I find this presumption that all mags are illiberal lock em up types irritating and stereotypical. We have sentencing guidelines which clearly set out the framework and my starting point is always to pursue all the options before custodial sentences.

Sure she will be liable to arrest & detention. But IMAO it seems contrary to the 8 USC s. 1231 framework for her to ‘remain in US in violation of law’. How can that be when the 90 days hasn’t started ? How can that be if S/S can’t usually remove an alien serving a custodial sentence in US jail ?
