Police: DUII arrest after driver flees crash, ends up in Bard Park
A 23-year-old Cornelius man was arrested on suspicion of DUII after police said he hit a parked car in Forest Grove late Sunday night, fled and drove into Bard Park.
Officers were dispatched at about 11:49 p.m. to a crash near 22nd Avenue and Kingwood Street, the Forest Grove Police Department said in a Facebook post Monday. Multiple callers reported the crash, according to the post.
Police found the vehicle disabled in the park. Before officers arrived, witnesses had "removed the driver from the vehicle to prevent him from continuing to drive," police said.
Both vehicles were damaged and towed, according to the post.
Forest Grove Fire & Rescue and an American Medical Response ambulance were originally dispatched to the crash, according to Washington County Consolidated Communications Agency dispatch audio reviewed by News in the Grove.
The driver, Mateo Torrez Santizo, was not hurt. He was arrested on suspicion of DUII, reckless driving and failure to perform duties of a driver and lodged at the Washington County Jail, police said.
Using a search warrant, officers determined Torrez Santizo's blood alcohol content was 0.12% about three hours after the crash, police said.
When a commenter on the post questioned the three-hour gap, the department said officers first bring a person arrested for DUII to the station for a breath test "to try to get the level as close as we can to the time of crash." The person has to be observed for at least 15 minutes, and officers must get their consent during that time, the department said.
"If there is no consent, we must then get a warrant for a blood draw or breath sample (as required by the 4th Amendment of the Constitution, search and seizure), which can take anywhere from 2-4 hours, which is often dependent on the time of day, day of the week, and many other variables," the department said.
