The Petitioner here is Mahmoud Khalil, currently detained by federal immigration authorities in Jena, Louisiana. The Petitioner’s motion at ECF 308 is granted to the extent the motion seeks release on bail from immigration custody. The motion at ECF 308 is denied as moot to the extent it seeks transfer to New Jersey. The ECF 308 motion is granted and denied for the reasons stated in court today. After the Court issued its decision on the ECF 308 motion, the Respondents orally moved for a stay of the decision. The motion was denied for the reasons stated in court. Pursuant to the Court’s decision on the ECF 308 motion, the Petitioner shall be released from immigration custody today. The release order shall become effective upon two conditions being met. First, the setting of bail conditions by the United States Magistrate Judge. And second, an order from the United States Magistrate Judge indicating that the bail conditions have been met. The bail conditions here shall not include any obligation that electronic monitoring be put in place or that a bond be Case 2:25-cv-01963-MEF-MAH Document 316 Filed 06/20/25 Page 1 of 2 PageID: 37152 immediately posted. There is no basis for that in the evidentiary record the parties have developed. Judge Paula Xinis on the government’s conduct in the Abrego Garcia litigation:

“Respondents did not just stonewall. They affirmatively misled the tribunal.”
Respondents instead found a fourth African country, Liberia. This time, when the Court sought information about Liberia and Costa Rica so to fairly assess the validity of Abrego Garcia's claims, Respondents did not just stonewall. They affirmatively misled the tribunal! They announced that Liberia is the only viable removal option because Costa Rica "does not wish to receive him," ECF No. 85 at 9, and that Costa Rica will no longer "accept the transfer" of him, ECF No. 75-6 1 5; ECF No. 85 at 14. But Costa Rica had never wavered in its commitment to receive Abrego Garcia, just as Abrego Garcia never wavered in his commitment to resettle there. See ECF No. 108 at 1; Maria Sacchetti, Costa Rica says it would accept Kilmar Abrego Garcia, contradicting U.S., WASH. C. Order To Show Cause This Court has already found "that the Defendants have failed to comply with this Court's Order at ECF No. 51" because they did not provide the required declaration. ECF No. 61 at 1. The Government's failure to provide that declaration also calls into question whether the Government is complying with the Court's Order Granting Preliminary Injunction, ECF No. 21, as modified by ECF No. 51. Defendants accordingly request that the Court order the Government to show cause why it should not be held in contempt for failing to comply with this Court's orders, in accordance with its inherent authority. See Shillitani, 384 U.S. at 370; Rainbow School, 887 F.3d at 617. 2 The Government has not asserted-let alone properly substantiated— any privilege that would allow it to withhold the information sought and Plaintiffs are aware of none. III. Conclusion For the foregoing reasons, Plaintiffs request that the Court (1) order the Government to take by end of the day Monday, April 14, 2025, the specific steps set forth above to comply with the injunction in this case; (2) order expedited discovery as set forth above; and (3) order the Government to show cause by 10 a.m. Monday, April 14, 2025 why it should not be held in contempt due to its failure to comply with the Court's prior orders.

Each feels actual malice towards President Trump in the colloquial sense: that is, each—Craig, Buettner, Baker, and Schmidt, as individuals, and the Times and Penguin’s relevant executives as corporations—subjectively wishes to harm President Trump, and each wish to manipulate public opinion to President Trump’s disadvantage to worsen his current and future political and economic prospects. ICYMI: Last night Judge Xinis—with the consent of plaintiffs!—agreed to a one-week pause in expedited discovery and daily status reports in the Abrego-Garcia case. This came after a few sealed filings. So here's hoping that actual progress is being made in securing Abrego-Garcia's release.

In the Kilmar Abrego Garcia case, Judge Xinis orders the government to file a brief addressing the legal and factual bases for its invocations of privilege—specifically, state secrets and deliberative process privilege—by Monday, May 12.
The Court has reviewed ECF No. 108, the Motion to Intervene and Unseal Court Records, and ECF No. 112, the Joint Motion for Discovery Conference. The Court hereby orders: 1. Parties' responses to the Motion to Intervene (ECF No. 108) are due by Tuesday, May 20, 2025. Any replies shall be filed by Tuesday, May 27, 2025. 2.
