This is not a good legal interpretation of what that law says. They can still consent to sexual activity extremely inebriated, they cannot consent passed out and they cannot consent to group chats trafficking them they didn’t know about it.
The law isn’t helping. New York’s voluntary intoxication loophole makes it nearly impossible for survivors to seek justice if they drank or used substances prior to an assault. Because of this loophole, Jane Doe’s assailants may never be held accountable under the law.

I am a Jane doe. A Jane doe that never pressed charges and was afraid to because I took the intoxicants willingly. I did not willingly allow what happened afterward. But it was my fault for being inebriated. At least that’s what I was taught.

Observe: if youre ever somewhere late night and see a passed out or deeply inebriated person a group is passing. Characterize how this plays out if it's a group of guys and a vulnerable woman, or group of women and a vulnerable guy.
If a man was at a party with a dozen women and he got so intoxicated that he couldn't function, he'd be about as safe as anyone could be because 99 times out of 100 the women would look after him and see that he got home safely.

unpopular opinion but honestly, it is a simple fact that people who are inebriated cannot judge what they are and are not capable of. In essence, driving drunk is a symptom of alcoholism. We shouldn’t be locking ppl up & shaming them, we should be trying to help them get better.

She made statements saying everything was consensual in the moment and that the guys were respectful of her boundaries. I've had sex while both me and my partner are inebriated and that doesn't automatically make me or my partner a rapist so I just think this case is a strange case of regret
