We need people to be able to safely report criminal/corrupt behaviour without fear of being sent to prison.

(How very weird this Govt, which once said it was all about transparency, thinks otherwise.)

Feel free to add your name if you agree.

Have you had a chance to send a letter or postcard to David? Written your local MP or Senator? Let the Attorney General know of your concerns? It doesn't have to be an essay. Every message, however short or long, counts.

It's 4 weeks today since @davidmcbride.bsky.social's day in the Appeals Court, Canberra. He is waiting in gaol for the court's decision.

The government could free him now and #pardonMcBride. #auspol

Please contact the Attorney General.

Enough is enough. We demand the Federal Government: Stop prosecuting Richard Boyle and pardon David McBride. Accelerate reform of our broken whistleblower protection laws. Establish a whistleblower protection authority. Stop prosecuting whistleblowers!

Image of David McBride with quoted text. "Most people did the right thing, most people were really good. The problem was with the commanders. This is the key to my complaint, to say: we became so enamoured with the media idea. If somebody was good-looking and a good talker, even if there was evidence to say that they had murdered someone, we were talking them up. And then we realised we might have backed the wrong people. And then we started saying: 'sh*t we need to get some non-entities, make scapegoats of them.' We can't be putting non-entities in gaol, just to protect famous people." David McBride

Conclusion 98․ The appellant has not established error in the primary judge’s conclusion in order 1(a) of McBride (No 2) that the oath of enlistment taken by the appellant does not define the duty of the appellant for the purposes of s 73A of the Defence Act and s 70 of the Crimes Act as extending to acting in the Australian public interest, even where in contravention of a lawful order. Nor has he established error in the primary judge’s conclusion in order 1(b) of McBride (No 2) that a lawful order contained in a “general order”, within the meaning of the Discipline Act, may define the scope of the duty of the accused under s 73A of the Defence Act and s 70 of the Crimes Act. To put it another way relevant to this case, a communication of the type referred to in s 73A or s 70 may not be in the course of a person’s “official duty” if that person was under a duty (which arises from, inter alia, general orders) not to make that communication. 99․ Accordingly, the appeal against conviction is dismissed.
