RSEO chapter of the Belfast Agreement invoked are not clear enough. However:

a) the rights in the RSEO chapter are not too dissimilar from the actionable rights of many international rights documents, including the ECHR; and

b) this conclusion is the result of a misdirection by the court. /2

Colin notes that the bullet points in RSEO look like they might be directly effective, but the broader paragraphs in RSEO are not to be directly effective. Explains the two bespoke obligations in Art 2: specific alignment with relevant equality directives in Annex 1, AND no diminution re RSEO. 8/

Colin notes that the further issue with the UKSC's judgment in that it requires RSEO to be underpinned by EU law, but declares RSEO to be all about sectarian conflict, at which point very little EU law will ever underpin it! Colin calls this obiter - but it has huge impacts obviously. 19/

It doesn't required the RSEO to be directly effective but a determination of diminution *of anything set out in the RSEO* will always require a legal determination of the terms in it? Saying this isn't what was intended is a complaint to raise with the UK government circa 2020, not now. 28/

Ultimately, it is the Court's reasoning that undermines the text and purpose of art 2(1) of the WF, creating an artificial division between RSEO rights that might be capable of direct effect and those which can't. I wonder if this might put the UK in violation of the WA. /end

Thanks for giving me a great laugh this morning. I particularly enjoyed that the drafters of the 1998 Agreement wouldn't have contemplated the fall of the Berlin Wall, and ignoring elements like para 4 RSEO. Maybe a bit more reflection needed?

As some of the parties had submitted, in fact, the language of s2(1) of the WF is *evidently* clear enough to satisfy the Demirel test: the obligation on the UK is to 'ensure that no diminution of RSEO rights' etc 'results from Brexit. The obligation presupposes the existence of those rights! /3

Professor Dickson here notes that the challenge in Dillon failed largely because the 'rights' being asked for did not exist in EU law; and notes that BGFA RSEO should not be overinterpreted for legal purposes. With respect, think that's missing the point - that's what Art 2 requires? 27/

Baroness Foster has a new question that they can't prepare for. Does it matter that the RSEO is in the multi-party agreement, and not in the international treaty part of the BGFA? (Eg, a political agreement is now being treated as legal text.) 26/

Committee asks how helpful Dillon is, given how vague it leaves whether specific RSEO elements have direct effect in UKSC's views. Sam says this is normal when we have new law. I respectfully disagree, because there is nothing new about direct effect bar the 'doubling' the UKSC demands. 14/

Chris indicates that Dillon may have restricted operation of Art 2. Depends on how eg all other elements of the RSEO are interpreted by what will have to be further court cases. Sam notes that 'civil rights' in RSEO were declared as not directly effective but that's all we know. 17/
