Chris notes that UKSC did not address what "everyone in the community" in RSEO means; NI courts have taken a relatively broad view of what the community is, but this might be subject to further litigation, much like everything else set out by Dillon. 23/
June 24, 2026 at 12:54 PM
(To be clear, this is the mention of 'civil rights' in the preamble of the RSEO - not like, *all civil rights* also mentioned there.)

Chris notes Dillon primarily failed on the Victims Directive as not being applicable to the Legacy Act. Nearly everything else = obiter. 18/
June 24, 2026 at 12:26 PM
Chris indicates that Dillon may have restricted operation of Art 2. Depends on how eg all other elements of the RSEO are interpreted by what will have to be further court cases. Sam notes that 'civil rights' in RSEO were declared as not directly effective but that's all we know. 17/
June 24, 2026 at 12:25 PM
Committee asks how helpful Dillon is, given how vague it leaves whether specific RSEO elements have direct effect in UKSC's views. Sam says this is normal when we have new law. I respectfully disagree, because there is nothing new about direct effect bar the 'doubling' the UKSC demands. 14/
June 24, 2026 at 12:17 PM
Sam says UKSC found that the direct effect test has to be applied to not only Art 2, but also to the part of the RSEO Chapter that an applicant relies on. I have issues. (He also then confusingly seems to imply that even the EU law underpinning RSEO needs to be directly effective - it doesn't.) 13/

Baroness Ritchie: Why do we have Art 2? How does it relate to the BGFA & RSEO? What's happened to the NIO's Explainer doc post Dillon?

Lord Carlile adds - how successful has Art 2 been at preserving pre-existing rights? 3/
June 24, 2026 at 11:50 AM
They're starting on the history of RSEO in the BGFA and how any of those provisions were enforced pre Brexit. Chris explains they were not, in the common understanding of the concept of 'enforcement'. Required subsequent legislation and given effect by a bunch of EU law as well. 2/

It doesn't required the RSEO to be directly effective but a determination of diminution *of anything set out in the RSEO* will always require a legal determination of the terms in it? Saying this isn't what was intended is a complaint to raise with the UK government circa 2020, not now. 28/
June 10, 2026 at 11:22 AM
Professor Dickson here notes that the challenge in Dillon failed largely because the 'rights' being asked for did not exist in EU law; and notes that BGFA RSEO should not be overinterpreted for legal purposes. With respect, think that's missing the point - that's what Art 2 requires? 27/
June 10, 2026 at 11:22 AM
Baroness Foster has a new question that they can't prepare for. Does it matter that the RSEO is in the multi-party agreement, and not in the international treaty part of the BGFA? (Eg, a political agreement is now being treated as legal text.) 26/
June 10, 2026 at 11:18 AM
Colin notes that the further issue with the UKSC's judgment in that it requires RSEO to be underpinned by EU law, but declares RSEO to be all about sectarian conflict, at which point very little EU law will ever underpin it! Colin calls this obiter - but it has huge impacts obviously. 19/
June 10, 2026 at 11:07 AM
But then the question becomes, is how do we determine if there is a diminution of a right underpinned by EU law that would not have happened but for Brexit? Eleni gives a good hypothetical. Easier with the Annex 1 Directives. Real limits to what is in RSEO per UKSC. 14/
June 10, 2026 at 11:00 AM
Criticizes UKSC decision that the VRD did not apply in Dillon. Lord Dodds comes in at this point - what would a diminution now look like, assuming there's direct effect? Eleni cites the UKSC three-part test, which is basically okay. UKSC gets to decide what's in RSEO... 13/
June 10, 2026 at 11:00 AM
Colin notes that the bullet points in RSEO look like they might be directly effective, but the broader paragraphs in RSEO are not to be directly effective. Explains the two bespoke obligations in Art 2: specific alignment with relevant equality directives in Annex 1, AND no diminution re RSEO. 8/

Ultimately, it is the Court's reasoning that undermines the text and purpose of art 2(1) of the WF, creating an artificial division between RSEO rights that might be capable of direct effect and those which can't. I wonder if this might put the UK in violation of the WA. /end
