We recommend that Congress clarify the scope of federal preemption and create a mechanism that allows DOE to appeal to EPA about state requirements that may exceed state authority. This could reduce legal disputes and accelerate cleanup.

only viable option is state preemption imo

we couldn't even get citywide ADUs, which is like a baby step to that

Staff proposed limiting non-emergency generator use (50 hours/year testing), forbidding diesel as primary power, and including a "100% renewable energy to the greatest extent feasible" expectation, but noted state preemption prevents requiring all-electric construction.

Judge Harris uses an opening to get to the merits of the preemption issue. The City argues that because the R2R ordinance doesn't specifically state that a tenant has to obtain a permit, it conflicts with building code reqs. That's not how this works, neither does R2R expressly override permit reqs

1) corporations don’t think/care about paying into PCEF, I can find video of Steve Novick saying so. Their accountants just pay it and move on

2) corporate activity taxes are how we cope with offshoring jobs, state preemption of local taxes etc

3) PCEF built apts, bus lanes, e-bikes, shade trees…

We should have learned the lesson from privacy that mediocre state Internet laws that aren’t specifically designed as temporary bandaids don’t accomplish much other than making good national policy harder later by sapping political economy and creating preemption puzzle boxes

Unclear how? Housing policy is traditionally a local responsibility but advocates have focused on state preemption because the politics are less cursed. Federal level is extremely limited - the road to housing act basically passed because it didn't change much.

O’Neill on When State Preemption of Zoning Serves Localism
Moira O’Neill (University of California, College of the Law, San Francisco; University of California, Berkeley - Institute for Urban and Regional Development) has posted Toward an Equilibrium: When State Preemption of Zoning Serves Localism on SSRN. Here is the abstract: Cities’ power over land use is substantial but not absolute. When local zoning blocks affordable housing for low- and middle-income people, states may step in to take back local zoning power previously granted to cities.

Whether Boulder can sue oil giants under state tort law is a pivotal test for corporate climate accountability. Preemption by federal law could shield energy companies nationwide, while a 4-4 deadlock or Boulder victory would allow local communities to seek damages for climate harms.
