If the mood of the pre‑campaign had somehow permeated the atmosphere of the royal reception at the Palace for National Day, this time there was an additional element of special significance. The ballots are the instrument with which democracies resolve their disagreements and conflicts. Precisely for that reason, Spaniards cannot vote with an electoral roll under suspicion. It would be an unprecedented situation in nearly fifty years of democracy, incompatible with the trust that should inspire an electoral process. The Supreme Court has decided to maintain precautionary measures that, according to the State Attorney, affect about 163,000 naturalized citizens through the so-called 'grandchildren law' and whose electoral registration raises questions of legality. It is a resolution of undeniable significance, but also a guarantee for all voters. The integrity of the procedure cannot be subordinated to the conveniences of those who run in the elections. The ball is back in the hands of a Constitutional Court forced to act against the clock. The State Attorney's Office has no option but to file an urgent amparo appeal invoking the flagrant violation of the right to active suffrage and the absolute defenselessness created by requiring the individual review of more than 160,000 consular files in a tight time frame. The Supreme Court maintains the suspension of the vote for Spaniards naturalized under the grandchildren law. Judicial activism in Spain has stopped keeping up appearances. There is no longer a need for the toga's modesty or the veneer of legal jargon. The recent decision by the Supreme Court's Civil and Administrative Chamber to reject the State Attorney's appeal and maintain the precautionary suspension of the vote for 163,020 Spaniards abroad is not an act of legal prudence. It is a political intervention (designed, that is, with ruler and compass) in the playing field of the general elections.
