The Cultural Landscape Foundation (TCLF), a consulting party to the Section 106 review of the Triumphal Arch, submits the following comments following Advisory Council on Historic Preservation (ACHP) Vice Chairman Travis Voyles' letter of September 24, 2026, letter to Tammy Stidham, Associate Regional Director - Lands and Planning, National Park Service (NPS), terminating the review. These comments are provided in advance of the meeting your office has scheduled with consulting parties on Tuesday, September 29, 2026, at 2PM ET. Mr. Voyles has written a singularly audacious letter. And, after TCLF was invited to only one consulting party meeting for what would be the second largest monument in Washington, D.C., to say that we're gob smacked is an understatement. Perhaps the most extraordinary and dangerous statement by Mr. Voyles is the following: "In recognition of the public's significant concerns regarding the adverse effects the undertaking would pose to historic properties, we are hereby terminating consultation pursuant to 36 CFR § 800.7(a)(4)." Rather than address the "public's significant concerns regarding the adverse effects" on one of the nation's most revered and symbolically important cultural landscapes through an authentic public engagement process that doesn't foreclose avoidance as a precondition, the administration through its proxy, the ACHP, has decided the public's role is meaningless, unimportant, and of no value whatsoever. Presently, Section 106 states: "The views of the public are essential to informed Federal decisionmaking (sic)." Mr. Voyles' statement can be read as a prelude to and consistent with the ACHP's intention to turn Section 106 into a regulatory eunuch. The revised regulations eliminate at least eighteen separate instances about public participation, access, and notification. Instead, there is new language that says the government will have "exclusive discretion to determine the usefulness of public participation."

Some context from the former chair of the ACHP.
As Chair of the ACHP, I terminated consultation only one time during my tenure - for the Lava Ridge wind energy project - and only after years of consultation between the federal agency (in that case, BLM), the state historic preservation office, Indian Tribes, and others. Termination of consultation is reserved for situations where the parties have diligently worked to resolve adverse effects of federal undertakings on historic properties and failed to come to an agreement. By prematurely terminating consultation on the Triumphal Arch proposed by President Trump, the ACHP and interim chair Travis Voyles are making a farce of the Section 106 process - enabling the National Park Service to fast-track an ill-conceived monstrosity that by its mere presence will disrespect the fallen heroes buried in Arlington National Cemetery and their families. True consultation has never occurred for the Triumphal Arch, and it looks like the Park Service and ACHP will bend over backwards to avoid it. While consulting parties and others consider their legal options, it is important to note that if the Triumphal Arch is expanded to include national security infrastructure, as the President recently announced it would, the whole project would have to undergo reviews under Section 106 of the National Historic Preservation Act all over again.

Today’s notification triggers a series of steps that will ultimately result in the ACHP issuing formal comments from the Vice Chairman to the Secretary of the Interior on the undertaking and its effects on historic properties. To meet the requirements of 36 CFR 800.7(c)(1), ACHP staff have opened a public comment period, which began today, to gather views from consulting parties and the public on recommendations the ACHP might make to the Secretary of the Interior regarding the undertaking, its effects on historic properties, and the resolution of the undertaking’s adverse effects. A meeting has been scheduled to provide consulting parties with an opportunity to provide their feedback. The comments that are received will inform the development of the Vice Chairman’s letter, which will also be provided to members during their opportunity to review the draft letter.

On September 22, 2026, the NPS provided the attached letter and Assessment of Effects to the ACHP stating that it believes further consultation to attempt to resolve adverse effects in this case would be unproductive. It provided more information regarding the public opposition to the project and the impasse between the agency and consulting parties. Following receipt of that letter, the ACHP terminated consultation today, September 23, 2026.

Pursuant to Section 800.7(c) of the regulations the ACHP is obligated to provide its comment within 45 days, however, Vice Chairman Voyles has stated his intent to do so by October 7, 2026. Outlined below is a brief summary of the undertaking and relevant issues. In accordance with the ACHP’s Operating Procedures at Section V.B.2.c.ii and to meet this abbreviated comment period, Vice Chairman Voyles has chosen to address this termination through the development of a Vice Chairman comment letter. Consistent with those procedures, a draft of the letter will be shared with the members for their review and input prior to being finalized. We intend to circulate a draft letter to the members for their review on Monday, October 5, with comments requested by noon ET on Tuesday, October 6. After hearing from constituents who saw construction equipment at the site of Trump’s proposed arch, I drove down to Columbia Island to see for myself.

I found workers operating heavy equipment who told me they were conducting archaeological work.
