#MerryMan
For a guy named Steve Merryman he doesn’t seem to be a very “merry man”

as to the tenants, the settlement requires Merryman to work to "eliminate millions of dollars in eviction filings and judgments involving former tenants, removing a major barrier to future housing"

AND

it gives those tenants right of first refusal to buy the housing Merryman is forced to sell

Oh happy day, happy day!
The sun is smiling, everything's okay.
I'm alive by God's design,
Oh happy day, I'm feeling fine!

Thinking about how I tried to draw Washington DC today on a map when talking about Ex parte Merryman and one of my students said, “Yeah, that’s not what it looks like.”

My favorite little detail in that is Judge Merryman correcting Trump’s lawyers’ German grammar by capitalizing “Zeitgeist” for them

(I don’t think a German loan word needs to be capitalized in English, but then again I’d expect Trump’s lawyers ought to be well-read in the original German)

Ironically, the Civil War was won by ignoring some Supreme Court decisions. Dred Scott, Ex parte Merryman spring to mind. Doubtless others. Not my area.

Their word is not final.

Fuck 'em.
5-4 for what it explicitly says in the constitution is incredible. They were this close to undoing the civil war entirely. bsky.app/profile/mjsd...
The Supreme Court strikes down Trump's attack on birthright citizenship. By a 5–4 vote, it holds that the 14th Amendment guarantees citizenship to children born of unauthorized and temporary immigrants. Roberts and Barrett join the three liberals. www.supremecourt.gov/opinions/25p...

The correct response was a military tribunal, and to follow the example of Lincoln in ex parte Merryman if SCOTUS objected.
Instead we even left Flynn and other conspirators like the secret service agents in positions of power. Failed to do the basic requirement of a head of government.

No administration in American history, not Jackson w/ Indian removal, not Lincoln in Merryman, not FDR over the New Deal, not Truman in Youngstown, not Nixon over the tapes, not Bush with Guantanamo, has openly defied a court order like this, much less one unanimously endorsed by the Supreme Court.

“The privilege of the writ could not be suspended, except by act of congress.” Ex Parte Merryman, 17 F. Cas. 144, 148 (C.C.D. Md. 1861).
Stephen Miller says they are “actively looking at” suspending the writ of habeas corpus, which is only allowed when the US has been invaded or during an insurrection, which would not allow people to challenge their incarceration in court if they are arrested and detained.
