Did your CPA help you set up nanny payroll, or did they hand it back to you? Most CPAs aren't really set up for it. Household employers file on Schedule H, not the quarterly Form 941 that business payroll runs on. It's a structural gap nobody talks about.

The IRS decides whether your nanny is an employee. Not you, not them. If they follow your schedule, work in your home, and care for your kids, they're an employee by definition. A 1099-NEC doesn't change that.
